Abstract
Tezimiz fıkıh düşüncesinin en önemli konulardan olup modern çağda kendisineolan ihtiyaç daha da öne çıkan, Müslümanların toplumsal ve kişisel olarak fıkhîhükümleri hayatlarına uygularken hangi konulara öncelik vermeleri gerektiği hususunubelirleyen Öncelikler Fıkhı (Fıkhu'l-evleviyyât) konusuna Gazzâli'nin usul ve füru'açılarından yaklaşımını sunmayı amaçlamaktadır. Zira İslam`ın doğru anlaşılarakhayata geçirilmesi ve müslümanların yaşamakta olduğu pek çok problemin çözümüdini hükümler arasındaki dengeyi gözeterek İslami sorumluluklar arasındaki ehemmühim, öncelik-sonralık sırasını ve bu sıralamayı sağlıklı bir şekilde yapabilmek içingerekli ilkeleri isabetli bir şekilde tespit etmekten geçmektedir. Bu ilkelerin tespiti içinGazzâlî'nin ortaya koyduğu öncü ve özgün değerlendirmeler büyük önem arzetmektedir.Çalışmamızın giriş bölümünde Gâzzâlî'nin biyografisine ve Öncelikler Fıkhı(Fıkhu'l-evleviyyât) ile ilgili genel bilgilere yer verilmiş, Gazzâli'de Öncelikler Fıkhıdüşüncesinin dayanakları ele alınmıştır. Birinci bölümde Gazzâlî'nin ÖnceliklerFıkhı'na yaklaşımı fıkıh usulü açısından değerlendirilmiştir. İkinci bölüm ise,Gazzâlî'nin Öncelikler Fıkhı düşüncesini uyguladığı muhtelif fıkıh alanlarındanörnekler içermektedir.
This thesis is about an important section of Fiqh, which is increasingly needed in themodern era, the islamic law of priorities (fiqh al-awlawiyyat), that examines which topics shouldbe prioritized for someone who practice Islamic law in his life, according to the approach of alImam Al-Ghazali in terms of usul (principles) and furu (branches of jurisprudence). Because theimplementation of Islam with a correct understanding and the solution of many problems thatMuslims experience depends on establishing a balance between religious provisions, what isimportant and what is more important, an order of priorities among Islamic responsibilities andthe principles which are necessary to make this order in a healthy way. In determining what theseprinciples are, the pioneering and original evaluations of al-Ghazali are of great importance.In the introduction of our study, it is given place to Ghazali's biography and generalinformation about the Islamic law of priorities (fiqh al-awlawiyyat) and the bases of the Islamiclaw of priorities in Ghazali's thought are discussed. In the first chapter, Gazzâlî's approach toIslamic law of priorities is evaluated in terms of Islamic law methods (usul al-fiqh). The secondchapter includes examples from various fields of Islamic law in which al-Ghazali applied thethought of Islamic law of priorities.
