ÖZET İMAM MUHAMMED’İN EL-ASL ADLI ESERİNİN İBADET BÖLÜMLERİNDE KIYAS TERİMİNİ KULLANMASI Her furû fıkıh eserinin arka planında müellifinin usul anlayışını barındırdığı düşünülmektedir. Şu halde ilk dönem Hanefî fıkıh ekolünün usulî görüşlerini Ebû Hanife ve Ebû Yusuf’a öğrencilik yapan Muhammed b. el-Hasen eş-Şeybânî’nin eserlerinde, bilhassa onun en kapsamlı ve ayrıntılı eseri olan el-Asl’da bulmak mümkün gözükmektedir. Şeybânî’nin el-Asl adlı eserinin ibadet bölümleri özelinde gerçekleştirilen bu çalışmada genel anlamda ilk dönem Hanefî usul anlayışında “kıyas” terimine nasıl bir anlam yüklendiği sorusuna cevap aranmaktadır. Özelde ise ibadet bölümlerinde “kıyas” terimini kullanmasından hareketle Şeybânî’ye fıkıh usulü edebiyatındaki “ibadetlerde kıyas” tartışması hakkında bir görüş izafe edilip edilemeyeceği tartışılmaktadır. IMAM MOHAMMAD’S USAGE OF THE TERM QIYAS IN THE PRAYERS SECTIONS OF HIS BOOK NAMED AL-ASL It is thought that every substantive fiqh work contains its author’s theory of fiqh conception in the background. Therefore, it seems to be possible to find methodological views of the early period Hanafi fiqh school in the works of Mohammad b. al-Hasan al-Shaibani, who was a student of Abu Hanife and Abu Yusuf, particulary in al-Asl, which is the most comprehensive and the most detailed work of him. In the present study, which was carried out in the prayers (ibâdât) sections of al-Shaibani’s work named al-Asl, the paper, in broad terms, searches for an answer to the question of what kind of a meaning was attributed to the term “qiyas” in the early period Hanafi theory of fiqh conception. In the narrower sense, the paper argues whether any opinion about the “qiyas in prayers” arguments in the theory of fiqh literature can be attributed to al-Shaibani who utilizes the term “qiyas” in the prayers sections.
