İNSAN HAKLARI AVRUPA SÖZLEŞMESİ SİSTEMİNDE İHLALLERİN ONARILMASI

Abstract

İnsan Hakları Avrupa Sözleşmesi'ne taraf devletler Sözleşme'deki yükümlülüklerini ihlal ettiğinde, ihlalden önceki durumun koşullarını mümkün olduğunca sağlayarak meydana gelen zararları gidermek ve benzerlerinin tekrarlanmasını engellemek için gerekeni yapmak durumundadır. Bu çalışmada, İnsan Hakları Avrupa Sözleşmesi sisteminde kabul edilen ve Sözleşme'nin ihlal edilmesi halinde etkili çözüm yolu sağlamada yüksek öneme sahip olan onarım yöntem ve araçları ele alınmaktadır. Çalışmada, Sözleşme ve Sözleşme'nin uygulanmasını denetleyici organlar tarafından ortaya konulan ve geliştirilen yaklaşımların etkili bir onarım mekanizması kurmada önemli role sahip olduğu savunulmaktadır. İnsan Hakları Avrupa Mahkemesi'nin pilot karar uygulaması ve bu uygulamayla birlikte taraf devletlere sunulan onarım yöntemleri bu bağlamda özel önem arz etmektedir. Çalışmada bu hususlar derinlemesine tartışılmaktadır.

The Contracting Parties to the European Convention on Human Rights are bound to restore as far as possible the situation existing before the breach, compensate the damage and take measures to prevent similar violations in the future. This Article examines the means and methods of reparation adopted in the European Convention on Human Rights system, which are of paramount importance in respect of an effective remedy in case of a violation. This Article argues that the approaches suggested and developed by the Convention and the corresponding monitoring bodies can be instrumental in setting up an effective reparation system. The Court's treatment of pilot cases and the following methods of reparation offered to the member states deserve a special focus. This Article discusses the foregoing in depth.
