İslâm hukukunda cihad literatürü ve Bedreddin İbn Cemâa'nın cihadla ilgili eserlerinin değerlendirilmesi

Abstract

İslâmiyette gerek müslüman toplumların diğer milletlerle olan savaş münasebetlerinde, gerekse bir din olarak İslâm’ın dünyaya hâkim kılınması şeklinde ifade edilebilecek idealin yaşatılmasında cihad olgusu merkezi bir öneme sahip olmuştur. Cihadın dinî ve hukukî boyutuna ışık tutmak maksadıyla oldukça erken sayılabilecek bir dönemde müstakil eserler telif edilmiş, bu sahadaki çalışmalar ilk dönemlerden modern çağa değin devam etmiş ve konu etrafında zengin bir literatür oluşmuştur. Bu çalışma, ilk asırlardan günümüze kadar cihad alanındaki literatürü ve bu sahada temsil gücü yüksek bir Şâfiî fakihi olan Bedreddin İbn Cemâa’nın ilgili eserlerinin incelenmesini konu edinmektedir. Bir giriş ve iki bölümden oluşan çalışmanın giriş kısmında ilk olarak cihad kavramının sözlük ve terim anlamları etrafında kavramsal çerçevesi çizilmiş, ardından fürû fıkıh kitaplarında cihadın nasıl bir tasnif dâhilinde ve hangi başlıklar altında incelendiği üzerinde durulmuş, ilave olarak her mezhepte temsil gücü yüksek iki eser seçilerek cihadın konu edindiği bölümlerin stesi tablo halinde sunulmuştur. teratürde cihadla ilgili eserlere ayrılmıştır. Bu bölümde ilk dönemlerden 20. yüzyılın ortalarına kadar kaleme alınmış kitap, risale ve makale türlerindeki eserler ele alınmış, kuruluşundan günümüze kadar Türkiye’de bu sahada telif edilen çalışmalara da yer verilmiştir. İkinci bölüm, İbn Cemâa ve cihada dair eserlerini konu edinmektedir. Bu çerçevede ilk olarak İbn Cemâa’nın hayatı, ilmî çalışmaları ve yaşadığı döneme değinilmiş, ardından siyaset ve cihad konularını ele aldığı Tahrîrü’l-ahkâm fî tedbîri ehli’l-İslâm, Müstenedü’l-ecnâd fî âlâti’l-cihâd ve Tecnîdü’l-ecnâd ve cihâtü’l-cihâd eserleri değerlendirilmiştir.

The phenomenon of jihād had a central importance in Islam, both in the war relations of Muslim societies with other nations, and in keeping the ideal that can be expressed as the domination of Islam as a religion to the World. As a matter of fact, in order to shed light on its religious and legal dimension, the issue of jihād was the subject of individual studies at a very early period. Studies in this field have continued from the early ages to the modern time and as a result, a rich literature has been formed around the subject. This study focuses on the literature in the field of jihād from the first centuries to the present, and the examination of the relevant works of Badruddīn Ibn Jamāʿa, who is a Shāfʿī jurist in this field. The study consists of an introduction and two parts. In the introduction part, after drawing the conceptual framework of the concept of jihād around its dictionary and term meanings, it has been dwelled on what classification and under which titles jihad is examined in fiqh books. In addition, two works that has high representation power were selected in each sect and the list of contents of the chapters that the jihād is about is presented in a table. The first chapter is devoted to works related to jihād in Islamic literature. In this section, books, treatises and articles which written from the first periods until the middle of 20th century were discussed, and studies in releated to literature are included from the establishment of Turkey to today. The second chapter deals with Ibn Jamâʿa and his works on jihād. In this context, firstly, Ibn Jamâʿa's life, his scholarly studies and the period he lived in were mentioned. Afterwards, his works on jihād and politics, Taḥrīr al-aḥkām fī tadbīr ahl al-İslām, Mustanad al-ajnād fī ālāt al-jihād and Tajnīd al-ajnād ve jihād al-jihād were evaluated.
