Türkiye'de ve Avrupa ülkelerinde gazetecilerin sosyal ve yasal hakları ve basın özgürlüğü

Abstract

Gazeteci, Basın Özgürlüğü ÖZET TÜRKİYE’DE VE AVRUPA ÜLKELERİNDE GAZETECİLERİN SOSYAL VE YASAL HAKLARI VE BASIN ÖZGÜRLÜĞÜ A.B. yolunda ilerleyen Türkiye’deki basın çalışanlarının yasal ve sosyal haklarının mevcut durumu; Türkiye’deki basın özgürlüğünün kapsamı ve sınırları ve A.B.’ye üye dokuz Avrupa ülkesindeki yasal ve sosyal haklar ve basın özgürlüğü bu çalışmada ele alınmıştır. Çalışmanın ilk bölümü Türk İş Hukuk sisteminde gazetecilerin yasal ve sosyal haklarının incelenmesine ayrılmıştır. Takip eden bölümde ise, Türkiye’de başta Anayasa olmak üzere, 5187 sayılı yasa ile detaylı bir şekilde ele alınan basın özgürlüğü ve kişilik haklarının korunması konularına değinilmiştir. Bu bölümde ayrıca gelişen teknolojiye bağlı olarak ortaya çıkan görsel ve işitsel alanda; basın özgürlüğü de incelenmiştir. Basın kuruluşları kamuoyunun haber alma özgürlüğünü yerine getirmek için ifade özgürlüğü hakkına sahip olmakla birlikte; basın özgürlüğünün sınırı olarak kişilik hakkına saygı duymak zorundadır. Basın özgürlüğü ile kişilik hakkı çatışmasındaki ince çizginin korunması; Yargıtay kararları ile de istikrar kazanmış uygulamalar ile sağlanmaktadır. Bu nedenle, çalışmada pek çok Yargıtay içtihadına da yer verilmiştir. Son bölümde Avrupa Birliği’ne üye ülkelerdeki basın özgürlüğü ve genelde çalışanlara özelde gazetecilere iş yasaları ile sağlanan haklar ele alınmıştır. Burada Avrupa’nın köklü ve eski devletleri olan Almanya, İngiltere, Fransa gibi ülkeler yanında Letonya , Çek Cumhuriyeti gibi Avrupa Birliği’ne yeni katılmış ülkelere de yer verilmiştir. FRINGE BENEFITS AND LEGAL RIGHTS OF JOURNALIST AND FREEDOM OF PRESS IN TURKEY AND EUROPEAN COURTRİES The current state of legal rights and fringe benefits of press employees in Turkey that makes significant progress toward the European Union, the content and limits of freedom of press in Turkey, and legal rights, fringe benefits and freedom of press in nine member countries of the European Union have been discussed in this study.The first part of the study has dealt with the analysis of legal rights and fringe benefits of journalists in Turkish Labor Law System. In the following section, the issue of press law and the protection of personal rights which are mentioned rigorously in Law No.5187 and especially in Constitutional Law has been dissucced. In this section, freedom of press which has came into existence depending on development of technology in visual and auditory fiels has been examined as well. Nonetheless the press organisations have the right of freedom of expression to fulfill the freedom of public to get the news, they are also obliged to respect the personal rights as the limits of freedom of press.The protection of the thread in the conflict between freedom of press and personal rights is provided by the practices which have gained stability with the judgements of Supreme Court. On this account, this study has included numerous of Supreme Court’s decisions.In the last chapter, freedom of press in the member countries of the European Union and rights that have been provided in general to emplooyes and in special to journalists by Labor Laws have been discussed.Beside the long-established countries of Europe, such as Germany, England, and France, the countries which have been joined to the European Union in the near past, such as Latvia, Czech Republic have been mentioned in this study as well.
