Abstract
ALEXİS DE TOCQUEVİLLE’İN DEMOKRASİ ANLAYIŞI Alexis de Tocqueville 1805 yılında, aristokrat bir norman ailesinin çocuğu olarak Verneuil’de doğmuştur. Hukuk eğitimi alan Tocqueville 1831 yılında “Ceza Hukukunda Reform” konusunu araştırmak üzere Amerika’ya gitmiştir. Ancak “Amerika’da Demokrasi” adlı eseri göstermektedir ki burada Tocqueville’in asıl olarak ilgisini çeken konu Amerikan demokrasisidir. Sosyoloji ve siyaset bilimi alanlarında yazılmış erken dönem kitaplarından biri olan eser, günümüzde siyaset sosyolojisi alanında bir klasik olarak değerlendirilmektedir. Tocqueville öngörüleriyle çağımıza ışık tutmaktadır.Tocqueville demokrasi, demokratik toplum örgütlerinin gelişimi, işlevi, demokrasilerdeki çoğunluk-azınlık ilişkisi gibi hukuk ve devlet düzenine ilişkin pek çok konuda yaptığı değerlendirmeleriyle okunmayı hak etmektedir. Bu çalışma ile Tocqueville’in “Amerika’da Demokrasi” adlı eserindeki görüşleri bağlamında demokrasi kavramı ele alınarak demokrasiyi ne gibi tehlikelerin beklediği ve bu tehlikeler karşısında devlet ve hukukun konumu ele alınmaktadır. Tocqueville buna ek olarak bir demokratikleşme ve demokratik kurum oluşturma alanı olarak sivil toplumun önemine vurgu yapmakta, demokrasilerdeki eşitlik-özgürlük arasındaki gerilime ilişkin değerlendirmelerde bulunmaktadır. Tüm bunlara ek olarak, çalışmada, özgürlükleri devlete karşı güvence altına almada sosyolojik ve hukuksal özerk yapıların gerekliliği gibi güncelliğini yitirmeyen, Tocqueville’in çok önceden önemine işaret ettiği konular irdelenmektedir. ALEXİS DE TOCQUEVİLLE’S DEMOCRACY UNDERSTANDİNG Alexis de Tocqueville was born as child of Norman aristocratic family in Verneuil, in 1805. After having legal education Tocqueville has gone to America to investigate Criminal Law Reform in 1831. However, Democracy in America has shown that Tocqueville here mainly interested in the American democracy.The work written in the field of sociology and political science was one of the early book is considered a classic today in the field of political sociology. Tocqueville shed a light to our age with his foresight. Tocqueville deserves to be read by many of his works such as the assessments with the development of democratisation ,democratic society, function as democracy for the majority-minority relations in the state of law and order issue.In this study, with consideration of democracy notion in Tocqueville's work Democracy in America what kind of dangers are expected and the position of law against these dangers are dicussed.In addition to this ,Tocqueville emphasizes to democratisation and the importance of a civil society as a field of establishing democratic institutions and evaluates the tension between equality-freedom in democracy.In addition to all these studies, the actual subjects that Tocqueville pointed out in advance, such as the necessity of sociological and legal autonomy structures for guaranteeing freedom against the state are examined.
