Ekolojik hasar sorumluluk sigortası

Abstract

Bize ve gelecek kuşaklarımıza ait olan çevremiz teknoloji, sanayi ve ticaretin gelişmesiyle her geçen gün daha da risk altına girmektedir. Çevre sorunlarındaki artış çevre ile ilgili tedbir alınması gerekliliğini doğurmuş, çevreye ait hükümler tüm gelişmiş ülkelerde Anayasa, Kanun ve Yönetmeliklerde yerini bulmuştur. Sadece ülkemizde değil tüm dünyada yeni uygulanmaya başlanan Ekolojik Hasar Sorumluluk Sigortası insan ve çevre üzerine verilen değerin artması ile gelişecek ve yaygınlaşacaktır. Çalışmanın amacı çevre ve sorumluluk kavramlarının incelenmesi, ekolojik hasarların boyutu ve sigortalanabilirliğinin analizi ve ülkemiz için zorunlu ekolojik hasar sorumluluk sigortasının gerekliliğinin açıklanmasıdır.

Our environment which belongs to us and our posterity is every day getting under risk with the development of technology, industry and trade. The increase of the environmental problems has caused the necessity of taking measures about the environment; and the judgments on environment have found place in the constitutions, acts, and regulations of all the developed countries. The Ecological Damage Liability Insurance which has newly been implemented not only in our country but also all the world will develop and pervade with the increase of the worth given to the human and environment. The aim of this research is to examine the environment and liability concepts; the analysis of the extent and insurability of ecological damages; and the explanation of the necessity of compulsory ecological damage liability insurance for our country.
