Publication: State of emergency in european human rıghts law and the state of emergendy regime in Turkey
Abstract
ABSTRAKT Avrupa İnsan Hakları Hukukunda Olağanüstü Hal ve Türkiye'deki Olağanüstü Hal Rejimi başlıklı bu çalışma iki ana bölümden oluşmaktadır. İlk bölümde Avrupa İnsan Hakları Hukukunda Olağanüstü Hal kavramı incelenmiş ve Avrupa İnsan Hakları Mahkemesinin yıllar içinde geçirdiği yapısal ve organik değişikliklere değinilmiştir. Yine aynı bölümde Konvansiyon'da yer alan temel hak ve özgürlükleri sınırlama sebepleri ve özellikle Konvansiyon'un 15 maddesindeki sınırlama sebepleri incelenmiştir. Avrupa İnsan hakları hukukunun önemli bir ilkesi olan takdir yetkisi ilkesinden sonra Konvansiyonun özgürlükleri sınırlama yetkisi veren 15 maddesi Avrupa İnsan Hakları Mahkemesi içtihatları ışığında etraflıca incelenmiştir. Türkiye'de ki Olağanüstü Hal Rejimi başlıklı ikinci bölümde öncelikle 1982 Türkiye Cumhuriyeti Anayasasındaki olağan durumlarda temel hak ve özgürlükleri düzenleyen maddeler incelenmiş akabinde ise olağanüstü hallerde temel hak ve özgürlüklerin düzenleyen maddelere geçilmiştir. Bu bölümde Konvansiyon ile aynı madde numarasını taşıyan 15. madde incelenmiştir. Normlar hiyerarşisine uygun olarak Anayasa maddelerinden sonra Olağanüstü hal Kanunu ve Olağanüstü Hal Kanun Hükmünde Kararnamelerine değinilmiştir. Kararnamelerin yasama denetimi ve anayasal denetimi meselesi ise bu bölümde incelenen son konulardır. Son bölümde ise Türkiye'deki olağanüstü hal rejiminin Avrupa İnsan Hakları Hukuku ile karşılatırmalı incelemesi sonucunda varılan yargılar yer almıştır.
ABSTRAKT This thesis with the topic of State of Emergency in European Human Rights Law and the State of Emergency Regime in Turkey is constituted of two main parts. The first chapter is about the state of emergency in European human rights law. After studying the historical and structural changes that the Court system has gone through the years, the limitation clauses and especially the limitation system of the article 15 of the Convention has been discussed. A very important principle of International Law the principle of Margin of Appreciation was another topic that has been discussed in the first chapter beyond the article 15 in the Court's jurisprudence. The second chapter of the thesis is about the state of emergency regime in Turkey. First the articles establishing the limitations on the rights and freedoms at normal times have been discussed. Afterwards the restriction of rights and freedoms at the state of emergency has been studied. In the second chapter a comparative study of the article 15 of the Convention and the article 15 of the 1982 Turkish Constitution has been done. After the related articles of the Constitution the state of Emergency Act of Turkey and the State of Emergency Decrees with the Force of Law has been discussed.
