Abstract

SOSYAL HAKLAR VE GÖÇMENLER: SON YİRMİ YILDA AVRUPA REFAH DEVLETLERİNDE GÖÇMENLERİN SOSYAL HAKLARI ÜZERİNE KARŞILAŞTIRMALI BİR ARAŞTIRMA: İNGİLTERE, İTALYA VE ALMANYA Günümüzde, küreselleşme olgusu birçok yorumcu tarafından ekonomik aktiviteyi ve insan davranışlarını şekilllendiren başlıca güç olarak değerlendirilmektedir. Son yirmi yılda, piyasaların uluslararasılaşması ve artan rekabet, uluslararası göç dinamiklerini derinden etkilemiştir. İletişim ve ulaşım teknolojilerindeki gelişmeler ve bu gelişmelerin hızla yayılması dünyanın pek çok yerinden farklı sosyal ve ekonomik statüdeki insanın hareketliliğini inanılmaz bir şekilde hızlandırmıştır. Bu hareketlilik, içinde keskin sınırlarla belirlenebilecek gruplar yerine, farklı yasal statülere sahip bireyler barındırmaktadır. Soğuk savaş sonrası dönemde değişen ekonomik ve siyasi dengeler, refah devleti ve vatandaşlık gibi modern kavramların yeniden tanımlanma çabasını beraberinde getirmiştir. Bu dönemde, uluslararası göç, Avrupalı refah devletlerinde önemli tartışmalara yol açmıştır. Farklı yasal ve ekonomik statülerdeki göçmenler, sosyal refah devletinden faydalanan ve vatandaşların çalıştıkları işlere göz dikmiş istilacılar olarak değerlendirilmiştir. Uluslararası göç günümüzde bütün dünya devletlerini etkileyen önemli bir güçtür. Ancak farklı yasal statülere sahip göçmen kategorilerinin sosyal hakları için yasal düzlemde belirli bir çerçeve oluşturulmuş olsa da, uygulamada oldukça zayıftır. Bu çalışmada, refah rejimi, göç politikaları, sosyal politika kavramları ve haklar nosyonu ışığında farklı göçmen gruplarının sosyal hakları üç Avrupa ülkesinde karşılaştırmalı bir biçimde incelenmiştir.

SOCIAL RIGHTS AND IMMIGRANTS: ACOMPARATIVE RESEARCH ON SOCIAL RIGHTS OF IMMIGRANTS IN EUROPEAN WELFARE STATES DURING THE LAST TWO DECADES: BRITAIN, ITALY AND GERMANY Today, the phenomenon of globalization is evaluated by most of the commentators as the major power that shapes the economic activity and human behaviour. In the last twenty years, internationalization of markets and increasing competition has deeply influenced the dynamics of international migration. The developments in communication and transportation technologies and the rapid expansion of these developments have incredibly accelerated the mobility of people who have different social and economic statuses. This mobility embraces individuals with different legal statuses in itself rather than groups that can be identified with rigid boundaries. In the post-Cold War period, the changing economic and political balance bring along the efforts of re-conceptualization of the modern concepts such as welfare state and citizenship. In this period, international migration have given rise to important debates in European welfare states. Migrants who have different legal and economic statuses have been evaluated as intruders benefiting from the social welfare state, having eye on the jobs that are worked by the citizens. Today, international migration is an important power that affects all states of the world. However, the social rights of immigrant categories with different legal statuses are weak in practice although a specific framework has been constructed in the legal platform. In this study, the social rights of different groups of immigrants were investigated comparatively in three European countries, Britain, Italy and Germany, within the light of the concepts such as welfare regime, immigration policies, social policy and the notion of rights.
