Hanefî mezhebinde fıkhî istidlâller bağlamında ziyâdetü’s-sika (tahâvî örneği)

Abstract

Bu çalışmada Hanefî fıkhındaki tercih ve istidlâllerdeki etkisi ve rolü bakımından hadislerdeki ziyadeler, bir kavram olarak ziyâdetü’s-sika’nın hükmü ve örnekleri çerçevesinde incelenmiştir. Hanefî mezhebinin görüşlerinin delillendirilmesi konusunda önemli bir yeri bulunan Tahâvî’nin (ö. 321/ 933) hadisle ilgili eserleri çalışmanın merkezinde yer almıştır. Çalışmanın amacı, rey ehli olarak anılan ve aklı ön plana çıkararak nakli ikinci plana atmakla ithâm edilen Hanefî mezhebinin hadis rivayetine verdiği önemi ortaya koymaktır. Bu bağlamda Hanefî haber teorisi ve tercih anlayışına dair genel kabul görmüş bazı prensiplerin ziyadeli rivâyetlerin kabulü ya da reddindeki yansımalarıTahâvî örnekliğinde ele alınıp incelenmiştir.

In this study, the multiples in the hadiths will be examined in terms of its effect and role in the choices and inferences in Hanafi jurisprudence, within the framework of the ruling and examples of ziyâdetü's-sika (Ziyādāt al thiqāt) as a concept. The works of Tahavi (d. 321/ 933), who have an important place in proving the views of the Hanafi sect, were at the center of the study. The aim of the study is to reveal the importance given to the hadith narration by the Hanafi sect, which is known as the people of rai and accused of putting the narration in the foreground by bringing the mind to the forefront. In this context, the reflections of some generally accepted principles on Hanafi news theory and preference understanding in the acceptance or rejection of multiple narrations are handled and examined in the example of Tahavi.
