Publication: Türkiye’de basın çalışanların yasal ve sosyal hakları ile istihdam problemleri
Abstract
Bu tezde Türkiye’de basın çalışanlarının yasal ve sosyal hakları ile işsizlik sorunlarına değinilmiştir. Özellikle 212 Sayılı Yasa, 4857 Sayılı İş Kanunu, Sendikalar Kanunu ve Toplu İş Sözleşmesi Grev ve Lokavt Kanunu ayrı ayrı incelenmiştir. Basın çalışanlarının istihdam problemleri “tekelleşme, teknoloji, mesleğin prestiji ve yeni mezun fazlalığı” bağlamında ortaya konmaya çalışılmıştır. İşsizlik sorunu, Türkiye’deki işsizlik problemi ile ilişkilendirilerek açıklanmıştır. Hem hukuksal hem de istihdam-sendikalaşma zemininde ele alınan konu, yöntem olarak seçilen literatür tarama ve anket ile aydınlatılmıştır. Ayrıca konu ile ilgili kişilerle özel görüşmeler de yapılmıştır. 1. Bölümde konunun tanımı, amacı ve önemi, yöntemi, varsayımlar belirtilmiştir. 2. Bölümde gazete ve gazetecinin tanımı yapılarak Türk Hukuk sisteminde gazeteci kimliği incelenmiştir. 3. Bölümde 5953 Sayılı Basın İş Kanunu’nun maddeleri tek tek incelenerek gazetecilerin yasal hakları açıklanmıştır. 4. Bölümde gazetecilerin sosyal hakları ve örgütlenme sorunlarına değinilmiştir. 5. Bölümde tekelleşme ve yeni teknolojilerin gazetecilerin istihdamı üzerine etkileri ve bu konu ile ilgili yasalar incelenmiştir. 6. Bölümde ise Türkiye’deki genel işsizlik problemi ile Türk basınındaki işsizlik problemi ortaya konulmaya çalışılmıştır. Araştırma Sonuçları bölümünde ise belirlenen varsayımlar çerçevesinde anket sonuçları değerlendirilmiştir.
Legal and social rights of media employees and their unemployment problem were dealt with in this study. Especially the law numbered 212, the act numbered 4857, The Act of Trade Unions, The Strike and Lockout Act of Collective Employment Agreement were examined separately. Employment problems of media employees were tried to be reveal in their relation with monopolization, technology, the prestige of the profession and with the excess of newly graduates. Unemployment problem was explained by relating it with general unemployment problem in Turkey. The topic which was examined both legally and in the employment- unionization axes was cleared by reviewing the literature and by giving a questionnaire. Moreover, face to face interviews wiht related people were carried out. The description of the topic, the aim, the importance of the study and the hyphothesis were stated in the first chapter. The newspaper and the journalist were described and the identity of the journalist in Turkish legal system was examined in the second chapter. The legal rights of the journalists were revealed by examining the Press Employment Act numbered 5953 in the third chapter. The social rights of the journalists and their organization problems were explained in the fourth chapter. In the fifth chapter, the effects of monopolization and the new technologies on journalists and the acts about these topics were examined. In the sixth chapter, the general unemployment problem in Turkey and specifically unemployment problem in media were discussed. Finally, the results of the questionnaire were discussed compared with the hyphothesis of this study.
