Kişiyi Hürriyetinden Yoksun Kılma Suçunda Etkin Pişmanlık (TCK.m.110)

Abstract

5237 sayılı TCK. sisteminde etkin pişmanlık, suç tamamlandıktan sonra mahiyeti etkin pişmanlığa müsait belli suçlar bağlamında cezayı ortadan kaldıran veya cezada indirim yapılmasını gerektiren şahsi sebep olarak kabul edilmiştir. Kişiyi hürriyetinden yoksun kılma suçuna ilişkin etkin pişmanlık hükmüne ise, Kanun'un 110 uncu maddesinde yer verilmiştir. Buna göre, bu suçu işleyen kişi, soruşturmaya başlanmadan önce mağdurun şahsına zararı dokunmaksızın, onu kendiliğinden güvenli bir yerde serbest bırakacak olursa cezanın üçte ikisine kadarı indirilir.

Effective remorse has been accepted as a personal cause that requires dissolving or reducing of penalty within the context of determined crimes that's nature is available for effective remorse after crime is completed, in Turkish Penal Code with the number of 5237. The effective remorse provisions specified to crime of deprivation of liberty is regulated in article 110 of the Law. According to this, if the person who committed this crime frees the victim voluntarily, in a safe place, prior to the commencement of an investigation and without having caused any harm to the victim, then the penalty to be imposed shall be reduced by two thirds.
