İslam ve Osmanlı hukukunda Bid’at kavramı

Abstract

Tezin amacı, bid'at kavramının İslâm ve Osmanlı hukukunda kazandığı anlamların tespiti ve değerlendirilmesidir. Tez iki ana bölümden oluşmaktadır. Birinci bölümde İslâm hukukunda bid'at kavramı incelenmiştir. İslâm alimleri terim olarak bid'atın tanımını yaparken iki gruba ayrılmışlar, bir kısmı tanımın kapsamını dar tutarken diğerleri geniş tutmuşlardır. Geniş tanıma göre bid'at Hz. Peygamber'den (sav) sonra ortaya çıkan her şeydir. Dar kapsamlı tanıma göre ise, Dinin tamamlanmasından sonra ortaya çıkan, dinle ilgili olup ilave ve eksiltme özelliği taşıyan şeylerdir. Bu bölümde İslam alimlerinin bid'atle ilgili görüşleri kaynaklarından tespit edilerek açıklanmıştır. İkinci bölümde Osmanlı hukukunda bid'at kavramı, adaletnameler ve kanunnameler çerçevesinde incelenmeye çalışıldı. Osmanlı hukukunda; şeriata, örfe, padişahın emrine ve kanun-i kadime aykırı olan şeylere, haksız yeniliklere bidat denmiştir. Padişahlar, Osmanlı devletinde yaygın olan bütün bid'at ve haksızlıkları ortadan kaldırmak için adaletnameler yayınlamışlar, adaletname metinlerini devlet otoritesini elinde bulunduran kişilere gönderdikleri gibi halka bildirmelerini de emretmişlerdir. Ayrıca kanunnamelerin bazı maddelerinde kaldırılan bid'atlerden söz edilmektedir. Aim of the thesis is to determine and appreciate the meanings of bid'at concept in Islamic and Ottoman law. Thesis is constituted by two main sections. In the first section we examine the bid'at concept in Islamic law. Islamic scholars has been divided into two parts while describing the bid'at concept as a term. Some of them have described the concept with a small comprehension while others has given it a large comprehensive description. According to the first description bid'at is everything come out after the death of Hz. Muhammed (sallallahu alaihi wa sallam) the prophet has died. According to the comprehensive description bid'at is a concept that has come out after completion of the religion and which has an additional or reducing feature from the point of view of the religion. In this section, Islamic scholars' views about the bid'at concept are determined from its resources and explained. In the second section, we have tried to examine the bid'at concept in Ottoman law, subject to code of justice and code of laws. In Ottoman law; everything which opposes against shariah, custom, order of the Ottoman emperor, old law and everything accepted as wrong innovations; are named as bid'at. Ottoman emperors have published codes of justice in order to remove all bid'ats and wrong innovations which are widespread in Ottoman state and ordered state officials to inform the people of the codes. In addition, we mentioned about bid'ats removed from some articles of the codes of justice.
