Implementation of safety management system in upper and lower tier establishments according to SEVESO III directive and special audit cases

Abstract

Tehlikeli kimyasalları içeren büyük endüstriyel kazalar, insanlar ve çevre için önemli bir tehdit oluşturmakta, büyük ekonomik kayıplara neden olmaktadır. Avrupa'da, 1976'da gerçekleşen ve Seveso ismiyle bilinen endüstriyel kaza, bu tür kazaların önlenmesi ve etkilerini azaltmaya ilişkin mevzuatın oluşmasına öncü olmuştur. Mevzuatın son hali olan Seveso III Direktifi, AB uyum sürecindeki Türkiye mevzuatına 2 Mart 2019 tarihinde 30702 sayılı Resmi Gazete’de yayınlanan “Büyük Endüstriyel Kazaların Önlenmesi ve Etkilerinin Azaltılması Hakkında Yönetmelik” ismi ile girerek alt ve üst seviyeli kuruluşlara birçok yükümlülük getirmiştir. Üst seviyeli kuruluşlar için Güvenlik Raporu hazırlamak ve alt seviyeli kuruluşlar için Büyük Kaza Politika Belgesi hazırlamak ve hem alt hem üst seviyeli kuruluşlar için Güvenlik Yönetim Sistemini kurmak bunlardan bazılarıdır. Bu tezde, Yönetmelik kapsamındaki kuruluşların yürütmesi gereken çalışmaların, ulusal ve yerel mevzuat uygulamalarının ve uygulamalardaki eksikliklerin belirlenmesi ile Aile, Çalışma ve Sosyal Hizmetler Bakanlığı tarafından gerçekleştirilmiş denetimlerden örneklemelere yer verilerek tezin bir rehber olması amaçlamaktadır. Gerçekleştirilen çalışma, kuruluşlarda gerçekleşebilecek planlı/ plansız denetimlere hazır olan kuruluşların, uygunsuzluk almadan büyük endüstriyel kazaları önlemek ve etkilerini azaltmak üzere gerçek bir sistem kurduğunu kanıtlamasını hedeflemesi açısından önemlidir. Seveso denetimlerde dikkat edilen noktalar, tamamlanması gereken eğitimler, hazırlanması gereken dokümanlar ve Güvenlik Yönetim Sistemine uygun saha uygulamaları açısından hâlihazırda gerçekleştirilmiş denetimlere dayanarak daha net bir çerçevede belirlenmiş olacaktır. Güvenlik Yönetim Sistemi konusunda alt ve üst seviyeli kuruluş işletmecilerinin bilgi sahibi olması, işletmecilerin tanımlara aşina olması, yöntemler ve uygulamalar hakkında bilgilenmesi ile bilinçli işletmeciler doğru seçimler ve yatırımlar yaparak ülkemizde yaşanacak büyük endüstriyel kazaların önüne geçilmesini sağlayacaktır. Güvenlik Yönetim Sistemini işletmelerinde yaşayan bir sistem haline getirilmesine öncü olacaklardır.

Major industrial accidents involving dangerous chemicals pose a significant threat to humans and the environment and cause great economic losses. In Europe, the industrial accident that occurred in the Seveso in 1976 led to the creation of legislation on the prevention and control of such accidents. The latest version of the legislation, the Seveso III Directive has brought many obligations to lower and upper tier institutions. Preparing a Safety Report for upper-tier organizations, preparing a Major Accident Policy Document for lower-tier organizations and establishing a Safety Management System for both lower and upper-tier organizations are some of them. In this thesis, it is aimed to be a guide by giving examples from the inspections carried out by the Ministry of Family, Labor and Social Services, by determining the studies that should be carried out by the organizations within the scope of the Regulation, the implementation of national and local legislation and the deficiencies in the applications. The study is important in that it aims to prove that the organizations that are ready for the planned / unplanned inspections that may take place in the organizations have established a real system to prevent major industrial accidents and reduce their effects without non-compliance. The points considered in Seveso audits will be determined in a clearer framework based on the audits that have already been carried out in terms of trainings to be completed, documents to be prepared and field applications in accordance with the Safety Management System. It will ensure that conscious operators are obtained as a result of the lower and upper tier establishment operators having knowledge, familiarity with the definitions, and knowledge of methods and practices. Therefore, by making the right choices and investments, it will be ensured that major industrial accidents in our country will be prevented, and the Safety Management System will become a living system.
