Hükmün inşai etkisi

Abstract

Günümüzde yaygın olarak kabul edilen görüşe göre dava türleri, mahkemeden talep edilen hukuki himaye taleplerine göre tasnif edilmektedir. Buna göre dava türleri; eda davası, tespit davası ve inşai dava olarak ayrılmaktadır. Bireyler arasındaki mevcut geçerli bir hukuki ilişkiyi sona erdirerek yeni bir hukuki durum yaratılmasının veya hukuki ilişkinin değiştirilmesinin yahut mevcut hukuki durumun ortadan kaldırılmasının talep edildiği dava inşai dava, yargılama neticesinde verilecek kabul kararı ise inşa hüküm olarak isimlendirilmektedir. Yargılama neticesinde verilecek olan kararlar hukuk âleminde farklı etkiler doğuracaktır. Bu etkiler; kesin hüküm etkisi, inşai etki, icrai etki, unsur etkisi, fer’i müdahile etkisi olarak söylenebilir. İnşai hüküm neticesinde ortaya yeni bir hukuki durum çıkmakta olup kural olarak inşai hüküm herkese karşı etkilidir. İnşai etki, inşai davaların kabulü halinde ortaya çıkan inşai hükmün bir etkisidir. İnşai etki, inşai dava ve hükümlere özgü bir hüküm etkisidir. Bununla birlikte inşai nitelikte ancak hüküm vasfında olmayan mahkeme kararları ile de inşai etkinin doğması mümkündür. Tezde hangi mahkeme kararlarının inşai etkiye sahip olduğu genel olarak tespit edildikten sonra hükmün inşai etkisi kavramı, diğer hüküm etkileri ile farklılıkları ve üçüncü kişiler yönünden ele alınarak karşılaştırmalı hukuk ile birlikte değerlendirilecektir.

According to the widely accepted view today, types of cases are classified according to the legal protection requests from the court. Accordingly, the types of lawsuits are divided into performance lawsuits, declaratory lawsuits and constructive lawsuits. A case in which a new legal situation is created by terminating an existing valid legal relationship between individuals, or a legal relationship is changed, or an existing legal situation is eliminated is called a constructive case, and the acceptance decision to be given as a result of the trial is called a constructive judgment. The decisions to be made as a result of the trial will have different effects in the legal world. These effects can be described as final judgment effect, constructive effect, executive effect, element effect, and secondary intervention effect. As a result of the constructive provision, a new legal situation emerges and, as a rule, the constructive provision is effective against everyone. Constructive effect is an effect of the constructive judgment that occurs in case of acceptance of constructive cases. Constructive effect is a judgment effect specific to constructive cases and judgments. However, it is also possible for a constructive effect to arise from court decisions that are constructive in nature but not of a judicial nature. In the thesis, after determining in general which court decisions have constructive effect, the concept of constructive effect of the judgment will be evaluated together with comparative law by considering its differences with other judgment effects and in terms of third parties.
