Aile hukukunda geçici hukuki korumalar

Abstract

Tezimizde “Aile Hukukunda Geçici Hukuki Korumalar” konusu üzerinde çalışılmıştır. Geçici hukuki koruma, yargılama faaliyetinin öncesinde veya yargılama faaliyeti devam ederken çeşitli sebepler neticesinde yargılama sonucu bakımından meydana gelebilecek olumsuz sonuçlara engel olma, doğabilecek zararı minimum seviyeye indirme ve nihai hukuki koruma aşamasına kadar tarafların haklarını koruma amacı güden bir usul hukuku kurumu olup aile ise, yaşadığımız toplumun temel taşını oluşturduğu kabul edilen; sosyal, ekonomik ve toplumsal bir birliktir. Aile hukuku hak kayıplarının ve zarar tehlikesinin önüne geçilip hukuki korumanın tesis edilmesi bakımından zaman faktörünün oldukça önem taşıdığı alanlardan biridir. Kanun koyucu aile hukukunun sahip olduğu kendine özgü yapıyı göz önünde bulundurarak aile hukukuna özgü geçici hukuki koruma tedbirlerini medeni yargılamadaki geçici hukuki koruma tedbirlerinden ayrı bir düzenleme konusu yapmıştır.In our thesis, the subject of “Interim Injunctions in Family Law has been studied. Interim injunctions are a procedural law institution that aims to prevent the negative consequences that may occur in terms of the outcome of the trial as a result of various reasons before or during the trial procedures, to minimize the damage that may arise and contains the purpose of protecting the rights of the parties until final legal protection stage. The family, on the other hand, is considered to be the cornerstone of the society, it is a social, economic and societal union. Family law is one of the areas where the time factor is very important in terms of preventing the loss of rights and the danger of harm and establishing protection. Considering the distinctive structure of family law, the legislator has made the interim injunctions specific to family law, a separate regulation from the interim injunctions in civil proceedings.
