Abstract
Elektronik imza; elektronik veriye eklenen veya elektronik veriyle mantıksal bağlantısı bulunan, elektronik verinin içeriğini garanti eden ve kimlik doğrulama amacıyla kullanılan elektronik veridir. Elektronik imza kanunu 15/ 01/ 2004 tarihinde resmi gazetede yayınlanmış ve 15/ 07/ 2004 tarihinde yürürlüğe girmiştir. Böylece yürürlükteki hukukumuza bir açılım getirmiştir. Ayrıca elektronik imza kanunu, AB giriş sürecinde atılması gereken bir adım olarak da önem arz etmektedir. Elektronik imzanın birçok çeşidi vardır ve özelliği gereği ileride birçok çeşidi daha oraya çıkacaktır. Sayısal imza ise elektronik imza çeşitleri içerisinde en güvenli ve yaygın olanıdır. Elektronik imza kanunu ile güvenli elektronik imzalar, el yazısı ile imzalar ile aynı hukuki sonucu doğurmaktadır. Ancak elektronik imza toplumumuzun çoğunluğu tarafından henüz bilinmeyen ama modern toplumlarda günlük hayatta sıkça kullanılan ve hayatı kolaylaştıran bir hukuksal düzenlemedir. Elbette toplumumuz için de gerekli olan bir düzenlemedir. Ayrıca günümüzde elektronik ortamda en güvenilir imza olmasına rağmen oluşturduğu risklerin sigorta ettirilmesi gerekmektedir.
Electronic signature is actually electronic data used for identity verification and guaranteeing contents of electronic data, either attached or connected to such data via logic connection. The Electronic Signature Code was first published in the Official Gazette on January 15th, 2004 and became into force later on July 15th, 2004. With this, a new perspective was introduced to our Law. In addition, Electronic Signature Code also represents an important step in the process of admission to EU. There are various types of electronic signature and due to its nature, there will be many more types in the future. Among them digital signature is a very dependable and widely used electronic signature. With the Electronic Signature Code secure electronic signatures carry the same legal authority as wet signatures made in handwritting. Although electronic signature is still not very well know by a majority of our people, it is however, a legal procedure widely and often used by western societies in order to facilitate everyday life. It is of course a necessary regulation for I society too. However, although electronic signature is the most reliable, secure, means of signing, risks that it is subject to must be secured by means of insurance.
