Gemilerin cebri icra yoluyla satışının uluslararası etkisi

Abstract

Günümüzde ticaretin uluslararası boyutu dikkate alındığında, küresel ticaretin olmazsa olmaz unsurlarından olan gemilerin yabancı devletlerin yetki alanına girerek muhtelif sebeplerle haczedildiği ve cebrî icra yoluyla satıldığı sınır ötesi uyuşmazlıklarla karşılaşılmaktadır. Gemilerin yabancı bir devletin hukuk sistemine tabi olarak satıldığı durumlar; satışın geçerliliği, satışın hukuki etkisi, bu hukuki etkinin diğer devletler tarafından tanınıp tanınmayacağı gibi hukuki sorunları gündeme getirmektedir. Söz konusu sorunlar, gemilerin cebrî satışının meydana getirdiği hukuki etkinin yeknesaklaştırılması ihtiyacını doğurmuştur. Bu sorunların bertaraf edilmesi amacıyla Gemilerin Cebrî Satışının Uluslararası Etkilerine İlişkin Birleşmiş Milletler Sözleşmesi (Pekin Konvansiyonu) kabul edilmiştir. Tezimizde gemilerin cebrî icra yoluyla satışlarının uluslararası etkisi, yeknesaklaşmayı hedefleyen Pekin Konvansiyonu ışığında incelemeye alınmıştır. Tezimiz üç bölümden oluşmaktadır. Birinci bölümde, gemilerin cebrî icra yoluyla satışına temas eden uluslararası düzenlemeler ele alınmıştır. İkinci bölümde ise tezimizin esas amacını teşkil eden Pekin Konvansiyonu’nun hükümleri etraflıca açıklanmaya çalışılmıştır. Son bölümde ise, Türk Hukuku uyarınca gemilerin cebrî satış prosedürü ele alınarak Pekin Konvansiyonu hükümleri çerçevesinde değerlendirmeler yapılmıştır.

Given the international dimension of trade today, it is increasingly common to encounter cross- border disputes where ships, as essential elements of global trade, are arrested and judicially sold due to various reasons, falling under the jurisdiction of foreign states. The situation where ships are sold under the legal system of a foreign state raises legal issues such as the validity of the sale, the legal effects of the sale, and whether these legal effects will be recognized by other states. The issues in question have created the need to standardize the legal effect of judicial sales of ships. To address these issues, “United Nations Convention on the International Effects of Judicial Sales of Ships” (“Beijing Convention on the Judicial Sale of Ships”) has been adopted. In this thesis, the international effects of judicial sale of ships is examined in light of the Beijing Convention, which aims for uniformity. This thesis consists of three chapter. In the first chapter, international regulations which touch on aspects of the judicial sale of ships through enforcement proceedings are discussed. In the second chapter, the provisions of the Beijing Convention, which constitute the main purpose of this thesis, are thoroughly explained. In the last chapter, the procedure for the judicial sale of ships under Turkish law is discussed, and evaluations are made within the framework of the provisions of the Beijing Convention.
