Abstract
Uyuşmazlık, her insan ilişkisinde ortaya çıkabilecek bir durumdur. Toplumlar ortaya çıkan uyuşmazlıkları kendikültürü üzerinden çözüme kavuşturur. Günümüzde yaşadığımız Türkiye toplumu, Anadolu geleneksel toplumuüzerinden gelişmiş ve bugüne gelmiştir. Kültürün birikerek ilerlemesi, bize, bugünü anlamak için geçmişe bakmamız gerekliliğini oluşturmaktadır. Bu nedenle Anadolu geleneksel toplumunda yaşanan uyuşmazlıklar çözümekavuşturulurken kadının nasıl rol aldığı, her ne kadar geçmişin bir anlatımı olsa da bugünü anlamamızı sağlayacaktır.Anadolu geleneksel toplumundaki uyuşmazlıkların çözümünde kadın sistematik olarak nesneleştirilmektedir. Romahukukundan günümüze eşyanın mahiyeti kullanma (usus), semerelerinden yararlanma (fructus) ve tasarruf (abusus) olarak gösterilmektedir. Kadın da bu mahiyete uygun olarak, uyuşmazlık çözümlerinde kullanılan, takasedilen, semerelerinden yararlanılan ve tasarrufta bulunulan konumundadır.Kadın, kan davasının uyuşmazlığının çözümünde; kullanılan, semerelerinden yararlanılan, berdel çözüm yönteminde; takas edilen, namus cinayeti uyuşmazlığının çözümünde ise; tasarruf edilen konumundadır. Bu nedenlekadın günümüz hukuku tanımına göre, açıkça, Anadolu geleneksel toplumundaki uyuşmazlık çözümlerinde bireşya olarak rol almaktadır.

Turkey where we lived in nowadys developed throygh traditional society of Anatolia and it has been come to today. The accumulation of culture is a necessity for us to look back to understand the present. For this reason, how the woman plays a role in resolution the disputes in the traditional Anatolian society will provide us to understand the present even though it is a narrative of the past. Women are systematically objectified in resolution disputes in the traditional Anatolian society. From Roman law to the present time, the qualification of the property has been identified as using (usus), benefit of the features (fructus) and disposal (abusus). In the property law. Accordingly, women’s position in dispute resolution; used, barter, benefited from their fruits and made disposal. The position of women, i) in the resolution of the dispute of blood feud; used and benefited of the features ii) in the resolution of the dispute of berdel; barter, iii) in the resolution of the dispute of honor murder; be disposal. Therefore, according to the definition of contemporary law, women play the role of property in dispute resolution in the traditional Anatolian society.
