Abstract
TÜRK CEZA HUKUKUNDA HAKSIZ TAHRİK 5237 sayılı Türk Ceza Kanununun 29 uncu maddesinde haksız tahrik kurumu düzenlenmiştir. Haksız tahrik kusurluluğu etkileyen bir hal olması nedeniyle cezayı azaltıcı etki taşıyan kişisel, kanuni ve genel bir kuraldır. Bu çalışmada haksız tahrikin tanımı, tarihi gelişimi, hukuki esası ve koşulları incelenmiştir. Ayrıca haksız tahrik kurumu benzer müesseseler ve diğer suç türleri ile karşılaştırılarak özel haksız tahrik hali irdelenmiştir.
THE CRİME OF PASSİON OF TURKİSH CRİMİNAL CODE Crime of passion is defined in Article 29 of Turkish Criminal Code No. 5237. Be cause of affecting faultiness, crime of passion which reducts punishment is personal, legal and general rule. In this study, the definition of crime of passion, historical development, legal basis and the conditions are examined. In addition, similar crimes of crime of passion and other types of crime were considered by comparing the specific state of crime of passion.
