Fransız Anayasa Konseyinin Uluslararası Andlaşmaların Denetimine İlişkin Genel Yetkileri

Abstract

Fransız Anayasa Konseyi, Anayasanın 54. maddesi çerçevesinde, uluslararası andlaşmaları onaylanmalarından ya da uygun bulunmalarından önce a priori denetlemektedir. Bu denetim çerçevesinde anayasaya aykırı bir uluslararası andlaşma, anayasa değiştirilmeden iç hukukta yürürlüğe giremez. Anayasa Konseyi ayrıca, sahip olduğu diğer denetim usulleri ile de uluslararası andlaşmaları a priori olarak denetleme yetkisini kendinde görmektedir. Anayasa Konseyinin bu tutumu, anayasanın üstünlüğünün sağlanması açısından önemlidir.The French Constitutional Council, under article 54 of the Constitution, reviews the international treaties a priori before they are ratified or approved. Within this context, a treaty which is found to be contrary to the constitution cannot come into force without changing the Constitution. Besides, the Constitutional Council, recognizes itself competent to review the treaties a priori by the other constitutional review mechanisms. This attitude of the Constitutional Council is important for ensuring the superiority of the constitution.
