İntihara yönlendirme suçu (TCK M. 84)

Abstract

İntihar kavramı; geçmişi çok eski tarihlere dayanan, çok boyutlu ve karmaşık yapıda olan bir kavramdır. Tarihsel süreç içerisinde başlangıçta topluluklar veya ülkeler tarafından çeşitli gerekçeler ile cezalandırılmış olan intihar kavramı, ilerleyen dönemlerde ise modern hukuk sistemlerinin gelişimi ile birlikte suç teşkil eden bir eylem olmaktan çıkarılmıştır. Gerçekten de günümüzde kişilerin intihar kavramına başvurmasını cezalandıran ülke kanunlarının sayısı, yok denecek kadar az sayıdadır. Günümüzde ülkeler genellikle kişilerin kendi hayatlarını sonlandırma eylemlerini cezalandırmak yerine kişilerin, üçüncü kişiler tarafından intihar kavramına yönlendirilmesini cezalandırmayı tercih etmektedir. Bu doğrultuda ülkemizde de kişilerin intihar eylemleri cezalandırılmamış; bunun yerine kişilerin yaşam haklarına müdahale teşkil eden bir eylem olma özelliğinde olan üçüncü kişiler tarafından intihar kavramına yönlendirilmesi eylemi, 5237 sayılı Türk Ceza Kanununun 84. maddesinde kanun koyucu tarafından yaptırım altına alınmıştır. Çalışmamız kapsamında da 5237 sayılı Türk Ceza Kanununun 84. maddesinde düzenlenmiş olan “İntihara Yönlendirme” başlıklı suç tipi, iki ana bölüm içerisinde incelenmiştir. Bu kapsamda çalışmanın birinci bölümünde intihara yönlendirme suçunun temelinde bulunan intihar kavramı ve intihara yönlendirme suçu ile ilgili olarak genel bilgilere çeşitli başlıklar altında yer verilmiştir. Çalışmanın ikinci bölümünde ise ilk bölümde altyapısını oluşturduğumuz intihara yönlendirme suçu; doktrindeki çeşitli görüşler ve yargı kararları eşliğinde suçun unsurlarına ayrılarak incelenmiş, tarafımızca birtakım değerlendirmelerde bulunulmuş ve çalışmamız bu bölüm ile birlikte sona erdirilmiştir.

The concept of suicide is a date back to ancient times and has a multidimensional and complex structure. In the historical process, the concept of suicide, which was initially punished by communities or countries for various reasons, has ceased to be an act that constitutes a crime with the development of modern legal systems in the following periods. Indeed, today, the number of country laws that punish people for resorting to the concept of suicide is almost non-existent. Today, countries generally prefer to punish the fact that people are led to the concept of suicide by third parties instead of punishing people's actions to end their own lives. In this direction, suicide acts of people are not punished in our country either; instead, the act of directing people to the concept of suicide by third parties, which is an act that constitutes an interference with their right to life, is 84 of the Turkish Criminal Code No. 5237 it has been sanctioned by the legislator in the article. Within the scope of our study, 84 of the Turkish Criminal Code No. 5237 was included the type of crime entitled “Directing to Suicide”, is examined in two main sections. In this context, in the first part of the study, the concept of suicide, which is the basis of the crime of directing suicide, and general information about the crime of directing suicide were included under various headings. In the second part of the study, the crime of directing suicide, the infrastructure of which we created in the first part, was examined by dividing into the elements of the crime accompanied by various opinions in doctrine and judicial decisions. In this context, evaluations were made and our study was concluded with this section.
