Abstract

ÖZEL HUKUKTA HAYVAN HAKLARI Ortak yaşam felsefesi ile harmanlanmış, konusunu evrensel değerlerin oluşturduğu ve bir anlam kazanabilmesi, devlet sınırları ötesinde insanlık ailesinin bütün üyelerinin çabalarını birleştirmesini gerektirmesi bakımından Dayanışma Hakları olarak adlandırılan günümüzün Üçüncü Kuşak Hakları, Hayvan Haklarının Anayasal temellerini oluşturur. Öte yandan bir haktan bahsedebilmek, bu hakka sahip olacak bir kişiyi gerektirir. Hayvana farklı bir hukuki statü tanınması ve bu sayede haklarının korunması konusunda dünyada bir ivme söz konusudur. Buna karşılık ülkemizde hayvan, halen daha eşya statüsündedir. Hayvana reva görülmüş bu statü, hayvanları koruma mevzuatı ile çelişmektedir. Hakkın özü menfaatlerin tatmini olduğuna, hakkın kullanımı esnasında devreye giren iradenin ise ayırt etme gücünden yoksun olanlar için temsilcileri tarafından kullanılabildiğine göre duygusal yetileri olan tüm canlı varlıklar hak sahibi olmaya elverişlidir. Hayvanların korunması yolunda en etkili yol, onların da hak sahibi kılınmasıdır.

ANIMAL RIGHTS IN PRIVATE LAW Third Generation Rights, which is combined with the idea of common life and contain global values and named as Rights of Solidarity because they necessitate the efforts of all humanity members beyond the nation boundaries, form animal rights' Constitutional bases. On the other hand, to mention a right, it is needed to a person that possesses this right. There is an acceleration about the recognition of a different legal status to animals and by the way about the protection of their rights. However, in our country animals are still in property status. This status conflicts with animal protection legislation. While the essence of the right is the satisfaction of the benefits and the will that is stage in during the usage of the right is used from the representatives for mentally incapable person, all living creatures with emotional faculty are adequate to have rights. The best efficient way for the animal protection is to make them holder of a right.
