Ebü'l-Hüseyn el-Basrî'nin Kitâbu'l-Mu'temed fî Usûli'l-Fıkh adlı eseri çerçevesinde umûm ve husûs anlayışı

Abstract

Ebü‟l-Hüseyn el-Basrî, Mu„tezile mezhebinin müteahhirun alimlerindendir. Kâdî Abdülcebbâr‟ın öğrencisi olan Ebü‟l-Hüseyn el-Basrî fıkıh usûlü alanında yazdığı “Kitâbu‟l- Mu„temed fî Usûli‟l-Fıkh” adlı eseri, mütekellimûn usûl metodu ile kaleme alınan dört temel eserden bir tanesidir. Daha sonraları Ġslam dünyasının önemli isimlerinden Fahreddin er-Râzî (ö. 606/ 1210) ve Ebû Muhammed el-Ġsnevî (ö. 772/ 1370) gibi alimlerin fıkıh usûlü eserlerinde bu kitaba atıflarda bulunmaları hatta nakilde bulunmaları, eserin önemini bir kez daha ortaya koymaktadır. Eser usûl konularını mütekellimûn metodu ile ele almıĢ ve incelemiĢtir. Fıkıh usûlü konularından âm ve hâs meselesi kaynaklardan istinbat/ hüküm türetme hususunda önemli iki kavramdır. Ġslam hukuk alimleri, Ģârinin maksadını anlamayı, bunlardan hareketle Ģer‟i hükümlere ulaĢmayı sağlayan usûl ilmi, lafızlarının konuluĢ amaçlarını ve bunların dilbilim açısından hükmü kapsama meselesini tartıĢmıĢlardır. Umûm ifade eden bir lafzın ifade ettiği umûmiyet ve bunun sınırlarını koymak elbette hükmün tezahürü için büyük önem arz etmektedir. Ancak usûl ilminin tarihine bakıldığında Ġslam fıkhı için ortaya konulan kurallar mütekellimûn metodu ve fukahâ metodu Ģeklinde iki ana baĢlık altında incelenmiĢtir. Fukahâ metodunun ortaya konulması Ehl-i Sünnet alimlerinin önde gelen isimlerinden Ġmâm Ebû Hanîfe‟ye (ö. 150/ 767) dayandırılmıĢtır. Ortaya koyduğu fıkıh usûlü kuralları da mütekellimûn metodunun ortaya koyduğu metottan daha güçlü olduğu kabul edilmiĢtir. Ancak Ehl-i Sünnetin diğer bir kolu olan ġâfiî mezhebi ve imamı olan Ġmâm ġâfiî (ö. 204/ 820) mütekellimûn metodunu benimsemiĢ ve fıkhî istinbatlarını bu metot üzere belirlemiĢtir. Bu çalıĢmada, iki fıkıh usûlü metodundan biri olan mütekellimûn metodunun en önemli dört eserinden biri olan “Kitâbu‟l-Mu‟temed fî Usûli‟l-Fıkh” adlı kitabında ele aldığı âm ve hâs lafızlarının muhtevası incelenecektir.

Abu al-Husayn al-Basri is one of the mutaakhirrun (late) scholars of the Mu'tazila sect. The work al-mu'tamad fi ushul fiqh of Abu al-Husayn al-Basri, a student of al-Qadi Abd al-Jabbar, which he wrote in the field of Usul al-Fiqh (methodology of Islamic jurisprudence), is one of the four basic works written with the methodology of mutakallimun (scholastic theologians of Islam). Afterwards, the fact that scholars like Fakhr al-Dīn al-Rāzī (d. 606/ 1210) and Abu Muhammad al- Isnawi (d. 772/ 1370), who are important names within the circle of Islamic scholars, refer to this book in their works of Usul al-Fiqh and even report it, reveals the importance of the work once again. The work has dealt with and examined its subjects related to Usul al-Fiqh with the methodology of mutakallimun. The issue of 'amm (generals) and hass (Particulars), which is one of the subjects of Usul al- Fiqh, are two important concepts in the deduction of provisions. The scholars of Islamic law have discussed the purpose of coining the wording of the science of Usul al-Fiqh, which enables to understand the purpose of the shari' (the law maker) and to reach the shar'i (Islamic law) rulings/ provisions based on them, and the issue of including the ruling/ provision in terms of linguistics. The generality expressed by a general word and setting its limits are of course of a great importance for the manifestation of the ruling/ provision. However, when we look at the history of the science of Usul al-Fiqh, the rules set forth for Islamic fiqh are examined under two main headings as the methodology of mutakallimun and the methodology of fuqaha (jurists). The introduction of the fuqaha‟s methodology is based upon Imam Abu Hanifah (d. 150/ 767), one of the leading names of Ahl as-Sunnah scholars. It is accepted that the rules of Usul al-Fiqh he put forward are more powerful than the ones presented by the mutakallimun‟s methodology. Nevertheless, another branch of Ahl as-Sunnah the Shafi'i sect and its pioneer Imam al- Shāfi„i (d. 204/ 820), adopted the mutakallimun‟s methodology and lay out his jurisprudence deduction according to it. In this study, the content of the âmm and hass concepts that are dealt in one of the four most significant works of the mutakallimun‟s methodology al-mu'tamad fi ushul fiqh will be examined.
