Abstract
HAKİMİN HUKUKİ SORUMLULUĞU Hakimlerin hukuka aykırı fiillerinden dolayı sorumluluğu hukuk devletinin bir gereğidir. İncelemenin temel konusunu hakimlerin yargılama faaliyetlerinden dolayı hukuki sorumluluğu oluşturmaktadır. Çalışmamızda hakimin yargısal faaliyetlerinden dolayı hukuki sorumluluğuna dair hükümler 1086 sayılı Hukuk Usulü Muhakemeleri Kanunu uygulaması sırasında oluşan yargı içtihatları ve doktrin görüşlerine de yer verilerek 6100 sayılı HMK () kapsamında tahlil edilmiştir. Bu kapsamda Hukuk Muhakemeleri Kanununda tahdidi olarak sayılan sorumluluk hallerine yer verildikten sonra hakimlerin yargısal faaliyetleri sırasında vermiş oldukları zarardan dolayı doğrudan Devlete karşı açılacak tazminat davası ve Devletin sorumlu hakime açacağı rücu davası incelenmiştir.Hakim, Hukuki Sorumluluk, Devletin Sorumluluğu, Tazminat Davası, Rücu.
LEGAL RESPONSIBILITY OF JUDGE The responsibility of judges because of their unlawful acts is the result of state of law. The main subject of this study is legal responsibility of judges because of their judicial actvities. In our study, the terms regarding legal responsibility of judges because of their judicial actvities were analyzed within Code of Civil Procedure No:6100.It is also given place to ruling cases and doctrine opinions which were formed during the practice of Code of Civil Procedure No:1086. In this context, after given place to responsibility situations counted conclusively in the Code of Civil Procedure No:6100, studied direct action for damages against to Government because of the damages occured during judges judicial actvities and the action for recourse against to the responsible judge by the government.
