Publication: Özel hastanelerin hasta hakları ihlallerinden sorumluluğu
Abstract
Özel sektörün sağlık alanında faaliyet göstermeye başlaması nedeniyle, özel hastanelerin verdiği hizmetler ve bu hizmetlere bağlı olarak ortaya çıkan hukuki ilişkilerin nitelendirilmesi ve oluşacak sorunların giderilmesi önem kazanmaya başlamıştır. Özel hastanelerin hasta hakları ihlallerinden sorumluluğu konusunun seçilme amacı, hastaneye kabul sözleşmesi kapsamında hasta ile hastane arasındaki ilişkinin hukuki niteliğini ve tarafların karşılıklı hak ve borçları belirlemek, özellikle hasta hakları ihlallerinde meydana gelen artışlara değinmek, hastaya verilen zararlardan dolayı hastanenin ve dolayısıyla hastanede çalışan hekimlerin sözleşme kapsamında sorumluluğu konusu hukuki boyutu ile incelemekti. Ayrıca hasta hakları ihlalleri veya hekimlerin hatalı müdahalelerinden dolayı açılan davalardaki artışlar da bu konunun seçilme nedenlerindendir. Tezimizde, özel hastane ile hasta arasındaki ilişkinin bir sözleşme olduğu tespit edilerek, hastaneye kabul sözleşmenin taraflarına yüklediği hak, borç ve sorumlulukları da incelenmiştir. Hastanenin borçları bir anlamda hastanın haklarını da oluşturmaktadır. Ayrıca Özel hastane ile hasta arasında akdedilen hastaneye kabul sözleşmesi, Anayasa ve Uluslararası bildirgeler ile güvence altına alınan ve ülkemizde sadece Yönetmelik düzeyinde yasal düzenlemeye konu olan hasta haklarına da uygun olarak yapılmalıdır. Bu nedenle tezimizde, temel insan haklarının sağlık hizmetleri sahasındaki yansıması olan ve hasta hakları konusuna da yer vermiş bulunmaktayız. Hastanın teşhis ve tedavisini sağlama, aydınlatma, rıza, sadakat ve özen borcu, kayda geçirme ve sır saklama yükümlülüğü olarak belirlenen hastanenin yükümlülükleri aynı zamanda hastanın haklarını oluşturmaktadır. Bu yükümlülüklerin, sözleşmenin ihlal edilmesi halinde, bir zararın meydana geldiği hallerde, hastanın zararına katlanmak yerine, bu zararını hukuki yollarla tazmin etmesi gerekliliğinin üzerinde durulmuştur.
It is becoming more important to define the services given by private hospitals and identify the juridical relations arising from these services since the private sector began to serve in the domain of health. The purpose of the selection of this subject about the responsibility of the private hospitals for patient right violations is to determine the legal character of the relation between the hospital and the patient within the scope of patient acceptance agreement and the mutual rights and liabilities of the parties partially to attract attention to the increasing patient right violations and to research the responsibility of the hospital and the legal concept of the responsibilities of the practitioners employed in the hospital within their employment agreements’ scopes. Another reason of this choice is the increase of the violations about the patient rights and the commenced lawsuits for the faulty medical interventions of the doctors. We had determined the relation between the patient and the private hospital as a contract in our project and investigated the rights, debts and obligations charged to the parties with this contract. In another sense, the debts of the hospital may be considered as forming the rights of the patient. Furthermore, the contract for acceptance to the hospital concluded between the patient and hospital must be in accordance with the patient rights those are ensured by the Constitutional Law and International Declarations and subjected for legal arrangement just in a regulation basis in our country. Therefore, we had also handled the matter of patient rights that is a reflection of main human rights to the health care services area. The liabilities of the hospital, which were identified as supplying diagnosis and therapy, informing, approval, allegiance and care obligations, recording and professional discretion liabilities are also forming the rights of the patient. It was determined that in case of violation of these obligations, that means the violation of agreement if damage caused the necessity to action for compensation of these damages through legal remedies by the patients instead of enduring the damages.
