Abstract
Gazetecilik mesleği toplumun güncel bilgi ve habere ulaşmasında son derece önemlidir. Gazetecinin toplumun haber alma ve bilgiye ulaşma hakkına katkı sağlayabilmesi için mesleğini icra ederken fikir özgürlüğüne sahip olması gerekmektedir. Aynı zamanda işini kaybetme endişesi de taşımamalıdır. Haberin ne zaman ve nerede ortaya çıkacağı çoğu zaman önceden bilinmemektedir. Gazetecinin kendine özgü çalışma şekli sebebiyle gazeteci ve işvereni arasındaki hukuki ilişki diğer çalışanlardan ayrı bir kanunla düzenlenmiştir. Söz konusu kanun kısaca Basın İş Kanuuu olarak adlandırılmaktadır. Tezimizin konusu, gazeteci tarafından yapılan fazla çalışmadır. Fazla çalışma, azami iş süresinin üzerinde yapılan ve karşılığında ilave ücret ödenmesini gerektiren çalışmadır. Gazetecinin fazla çalışma yapması halinde ödenecek ücret, ispat, faiz ve yaptırım konuları açıklanmıştır. Ayrıca fazla çalışmaya ilişkin ilgili kanun hükümlerinin yanı sıra kanunda boşluk bulunan hallerde uygulanacak hükümlerin de tespiti yapılarak, uygulanacak hükümlerin tamamı konuya ilişkin yüksek mahkeme kararları ile birlikte incelenmiştir.
The profession of journalism is extremely important for the society to reach up-to-date information and news. In order for journalists to contribute to the right of the society to receive news and access to information, they must have freedom of opinion while performing their profession. At the same time, they should not have to worry about losing their job. When and where the news will appear is often not known in advance. Due to the journalist's unique way of working, the legal relationship between the journalist and employer is regulated by a separate law from other employees. The mentioned law is shortly called Press Labour Code. The subject of our thesis is the overtime done by the journalist. Overtime is the work that needs to be paid extra than the regular wage. In case of overtime done by the journalist the subjects of wage, proof, interest and sanction have been explained. Besides the relevant law regarding the overtime, the provisions to be applied in case of loopholes in the code were detected and all of the provisions were examined according to the rulings of the supreme court.
