Abstract
Sendika özgürlüğü ilkesine göre işçiler, diledikleri sendikaya üye olabilir, diledikleri zaman üyelikten ayrılabilir ve dilerlerse hiçbir sendikaya üye olmama haklarını kullanabilirler. Taraf sendikaya üye olmayan ya da üyelikten ayrılan işçilerin toplu iş sözleşmesinden yararlanıp yararlanamayacaklarının belirlenmesi gerekir. 6356 sayılı Sendikalar ve Toplu İş Sözleşmesi Kanununda, sendika özgürlüğü ilkesiyle uyumlu bir düzenleme yapılarak taraf sendikaya üye olmayan işçilerin dayanışma aidatı ödeyerek toplu iş sözleşmelerinden yararlanmasına imkân veren bir düzenleme getirilmiştir. Buna göre, taraf sendikaya üye olmayan işçiler dayanışma aidatı adı altında bir miktar para ödeyerek ve yararlanma talebinde bulunarak imza tarihinden itibaren yürürlük süresiboyunca toplu iş sözleşmesinden yararlanabilirler
According to the principle of trade union freedom, a worker canjoin any union, can resign at any time and use his right not to join anytrade union. It is necessary to determine how the workers who do notjoin trade union that is a party to the collective labour agreement orresigned from the union, can be benefitted from the collective labouragreement. In the Trade Unions and Collective Labour Agreement Actnumber 6356, a regulation is made considering that principle. Thatregulation is compliance with trade union freedom that allowsemployees who are not member to a signatory trade union arebenefitted from the collective labour agreement. Thus, employees whoare not a member of a signatory trade union can benefit from thecollective labour agreement from the date of signature to the endsolely by paying a solidarity due to the union
