venliği, İşyeri Hekimi, İş Güvenliği Uzmanı ÖZET İŞVERENİN İŞYERİ HEKİMİ VE İŞ GÜVENLİĞİ UZMANI ÇALIŞTIRMA YÜKÜMLÜLÜĞÜ 6331 sayılı İş Sağlığı ve Güvenliği Kanununun yürürlüğe girmesiyle birlikte “kademeli olarak hayata geçecek olsa da” Kanunun kapsamına giren tüm kamu/ özel sektör işyeri işverenleri, işyeri hekimi ve iş güvenliği uzmanı çalıştırma yükümlülüğü altındadır. Kazuistik bir yapıya sahip olmayan söz konusu Kanun, işyerlerinde sağlık ve güvenliğin sağlanmasında genel bir çerçeve çizmekte, her işkolunun spesifik özelliklerine ve işyerlerinin subjektif durumuna göre işverenleri gerekli tüm önlemleri almakla yükümlü kılmaktadır. İşyerlerinin iş sağlığı ve güvenliği politikasının belirlenmesinde ise işyeri hekimi ile iş güvenliği uzmanının işverene yapacağı rehberlik ve danışmanlığın önemi ön plana çıkmaktadır. Bu çalışmada, önleyici iş sağlığı ve güvenliğinin iki önemli aktörü olan işyeri hekimi ve iş güvenliği uzmanının iş sağlığı ve güvenliği sistemimizdeki rolü ile bu kişilerin çalıştırılmasına ilişkin esaslar incelenmiştir. Sistemin sağlıklı işleyebilmesi için yeterli sayıda nitelikli hekim ve uzmanın yetiştirilmesinin ve bu kişilerin mesleki bağımsızlık içinde görevlerini ifa etmelerinin önemi ortaya konmuştur. EMPLOYER’S OBLIGATION OF EMPLOYING IN-SITE OCCUPATIONAL PHYSICIAN AND OCCUPATIONAL SAFETY SPECIALISTS With the inuring of Occupational Health and Safety Law no 6331, “even implemented fractionally”, all the public/ private sector workplace employers are under the obligation of employing on-site occupational physician and safety specialists. The law in question which doesn’t have casuistic structure draws a general frame for ensuring health and security in workplaces, and obliges employers to take all the necessary precautions according to each line of work’s specific characteristics and workplaces’ subjectivity. In determining the workplaces policy of occupational health and safety, the importance of occupational physician and safety specialist’s guidance and counseling to the employer comes into prominence. In this study, the role of on-site occupational physician and safety specialists in our system of occupational health and safety, who are two significant actors of preventive occupational health and safety, is analyzed together with principles related to employing of these people. In order to provide the healthy operation of the system, the importance of educating sufficient qualified doctors and specialists and ensuring them to perform their duties in occupational freedom is put forward. Solution offers to the detected problems within this framework are included.
