Publication: Hukukun davranışı teorisi ve ampirik analizi
Abstract
Bu çalışmanın amacı, hukukun niceliksel bir veri olarak ele alınmasını sağlayan Hukukun Davranışı Teorisi’nin temel unsurlarını araştırmak ve bu teoriden hareketle ampirik bir inceleme yapmaktır. Çalışma, üç ana bölümden meydana gelmektedir. İlk bölümde, kuramsal çerçeve ile hukuku bir davranış çalışması olarak ele almanın temellendirilmesi yapılmış, bilimsel bilgiden başlayarak sosyolojinin ve hukukun değerden bağımsızlığının koşulları açıklanmıştır. İkinci bölümde, toplumsal geometri bağlamında kavramsal çerçeve çizilerek hukukun nicel bir veri olarak incelenmesini sağlayan temel kavramlar betimlenmiştir. Üçüncü bölümde, hukuku bilimsel bir veriye çevirmeye muktedir saf sosyolojik yöntemin temel düsturları üzerinde durulmakla birlikte, Hukukun Davranışı Teorisi’nin ampirik analizine yer verilmiştir. Ampirik çalışmada, teorinin temel önermelerinin Türkiye’de 2018 yılında işlenen cinayet vakalarının gazete haberleri üzerinden elde edilen verilerle sınaması, içerik analizi vasıtasıyla yapılıp, hukuk miktarını etkileyen toplumsal örüntülerin tespiti sağlanmıştır. Çalışma neticesinde, hukukun toplumsal uzam ve zamanda nasıl hareket ettiği ve bu hareketin yönü belirlenmiştir.
The aim of the current study was to investigate the key elements of the Behavior of Law Theory that ensure the law is treated as quantitative data and to make an empirical examination based on this theory. The study consists of three main parts. In the first chapter, starting from scientific knowledge, through the value-free sociology and law are revealed the conditions that enable the law as a study of behavior are grounded by presenting the theoretical framework. In the second chapter, in the context of social geometry, the conceptual framework has been drawn and the basic concepts of the theory which treats law as quantitative data have been explained. In the third chapter, together with including empirical analysis of the Behavior of Law Theory, the basic principles of the pure sociological method that capable of transforming the law into scientific data are emphasized. In the empirical study, by testing the basic hypothesis of the theory through using content analysis, by way of newspaper reports of murder cases in 2018 in Turkey, the social patterns that affect the quantity of law have been detected. As a result of the study, it has been determined how the law behave in social space and time and the direction of this behavior.
