Sermaye şirketlerinde sermaye kaybı, borca batıklık ve teknik iflasın sonuçları ile alınabilecek iyileştirici önlemler kapsamında mali tablo analizi

Abstract

Bu çalışmada; sermaye şirketlerinde, sermaye kaybı, borca batıklık ve teknik iflas kavramları, bu durumların tespiti ve alınabilecek tedbirler üzerinde durulmuştur. Bu bağlamda TTK madde 376 ile bu maddenin uygulanmasına ilişkin Tebliğ hükümleri irdelenerek, Tebliğ ile getirilen değişikliklere değinilmeye çalışılmıştır. Halka açık bir şirketin mali tablo analizleri yapılarak, elde edilen bulgular değerlendirilmiştir. Çalışmanın sonucunda ise şirketin durumuna ilişkin tespitlere yer verilerek, şirketin durumunu iyileştirici tedbir önerilerinde bulunulmuştur.

In this study, capıtal loss, over-indebtedness and technical bankruptcy in the capital companies, determination of these situations and measures that can be taken has been examined. In this context, article 376 of TCC and the Communique on the implementation of article 376 of TCC have been examined and the changes introduced by the Communique have been tried to be addressed. Financial statement analysis of one of the publicly held companies has been made and the findings have been evaluated. In conclusion, determinations regarding the situation of the company have been included and suggestions in order to improve the situation of the company have been proposed.
