El-Hakim Et-Tirmizi’nin islam hukuk felsefesine katkıları (özellikle İlelü’l-İbadat adlı eseri çerçevesinde)

Abstract

İllet fıkıh usulünün en önemli konularından birisidir. Bu nedenle hükümlerdeki illetin belirlenmesi İslam Hukukçularının en önemli uğraşlarından biri olmuştur. Biz de bu tezimizde Hakim et-Tirmizî'nin İlelü'l-İbadât adlı eserini tahkik etmek istedik. Üç bölüme ayırdığımız çalışmada ilk olarak müellifin hayatı ile yaşadığı devri tanıttık. İkinci bölümde eseri tanıttık. Üçüncü bölümdeyse eserin tahkikli metnini verdik.

İllah(ratio-legis) is one of the most important topic of the Islamic Jurisprudence. Therefore, determination of illah in rules has been one of the most important goals of Islamic Jurists. I have attempted to make a critical edition of the Hakim al-Termedi's work, İlelu'l-İbadât. I have divided thesis into three chapters. At the first chapter I have focused on the life of Hakim al-Termedi and the conditions of the age which he lived. At the second I have introduced the book of Hakim al-Termedi. Finally, I have put forward the criticised text of the Termedi's work.
