Publication: Çağdaş İslam hukukçusu Tahir b. Aşur’da maslahat kavramı
Abstract
TEZ ÖZETİ (TÜRKÇE) Çağdaş İslâm Hukukçusu Tâhir bin Âşûr'da Maslahat Kavramı adını taşıyan çalışmamız bir giriş ve üç bölümden oluşmaktadır. Giriş kısmında, araştırmanın amacı, planı, giriş niteliğinde de olsa bilinmesinde fayda mülahaza ettiğimiz İbn Âşûr'un dönemi ve hayatı hakkında temel bilgilere yer verilmiştir. Modernizm ve İslâm Dünyasına Yansımaları başlığını taşıyan birinci bölümde, maslahat kavramının, modern dönemde İslâm hukukunun değişen zaman ve şartlara adapte olabilmesini sağlayacak bir prensip olarak yorumlanmasının tarihi arka planına işaret edilmeye çalışılmıştır. İkinci ve üçüncü bölüm, değişmenin zaruriliği, imkanı ve yöntemine dair tartışmalar yürütülürken, bu mevzuya dair müstakil bir eser yazarak dikkatleri üzerine çeken İbn Âşûr'a ayrılmıştır. Çalışmamızın temel kaynağını teşkil eden Makâsıd adlı eseri müellif, değişen zamanlar için bir başvuru kaynağı olarak hazırladığını ifade ettiğinden ilk önce Âşûr'un genel olarak İslam hukuku ve değişim irtibatını hangi kavramlar aracılığı ile kurduğu tespit edilmeye çalışılmıştır. Daha sonra da müellifin maslahat yorumunun ortaya çıkarılmasına, maslahatın Makâsıd ilmi içerisindeki yerinin tespitine, muhtevasının tetkikine ve Âşûr'un yorumunun kavramın klasik yorumundan faklı olan noktalarının tespitine çalışılmıştır. Müellifin maslahat anlayışı hakkındaki genel değerlendirmenin ise sonuç başlığı altında yapılması cihetine gidilmiştir. TEZ ÖZETİ (
) My master thesis whose name is The Concept of Maslahat in Modern Islamic Thinker Tahir bin Asur contains four chapter the first of which is introduction. In the introduction part, as a prelude I give a short but crucial information which will make easier to inquire and analyse the period that Ibn Asur lived and his life. In the first chapter of my master thesis, namely Modernism and its Reflections in the Islamic World I put a special emphasis on the historical background about the interpretations which accept the maslahat concept as a tool that facilitates the adaptation of Islamic law to changing nature of the time and condition. The second and third chapter are separated to the evaluation of arguments related to the necessity, possibility and methodology of changing nature of Islamic law and especially Ibn Asur who wrote a separate and noticiable book about the issue. Since, for his work Makasid, which also became a basic source for us, Ibn Asur stresses that he prepared that book as a substantial source for changing nature of the times, I first study to represent the relationship between Islamic law and Asur's line of changing structure based on his concept preferences. Then I examine his interpretation of maslahat concept and I study to demonstrate the position of maslahat concept in the knowledge of Makasid, and the analysis of its contents. In the next step, I inquire the differences between the interpretation of Asur and other classical forms. In the conclusion part, I make a general evaluation about the maslahat understanding of Ibn Asur.
