Abstract
Çalışmada, uluslararası sorumluluk hukukunda iştirak kavramı derinlemesine incelenmiştir. İlk bölümde, ceza hukuku ve uluslararası ceza hukukunda iştirak kavramına yaklaşım değerlendirilmiş ve beraberinde, uluslararası sorumluluk hukukunda iştirakin gelişim süreci Uluslararası Hukuk Komisyonu raporları doğrultusunda gözlemlenmiştir. İkinci bölümde uluslararası sorumluluk hukuku disiplininde iştirak rejimleri kendilerini oluşturan unsurlarla birlikte detaylı olarak ele alınmış ve tartışılmıştır. Üçüncü ve son bölümde ise, iştirak kavramının uluslararası düzenlemeler ve uygulamadaki yansımaları ile iştirak sorumluluğunun kapsamı ve uygulanmasına yer verilmiştir. Nihayetinde, uluslararası hukukta iştirake yönelik birçok ihlal olmakla birlikte bu ihlallerin önüne geçilebilmesi için kavramın sınırlarının net biçimde çizilmesi amaçlanmıştır. Bu doğrultuda, uluslararası haksız fiilde iştirak rejimlerine ilişkin revize edilmiş bir sorumluluk modeli ileri sürülmüş ve kodlanmış kuralların hayata geçirilmesi noktasındaki eksikliklere dikkat çekmek amaçlanmıştır.
In this thesis, the concept of complicity in international responsibility law is examined in depth. In the first chapter, the approach to the concept of complicity in criminal law and international criminal law has been evaluated and the development process of complicity in international responsibility law has been observed in line with the International Law Commission reports. In the second chapter, complicity regimes in the discipline of international responsibility law, together with their constituent elements, are discussed and argued in detail. In the third and last chapter, the reflections of the concept of complicity in international regulations and practice, and the consequence and implementation of the responsibility of complicity have been explained. Finally, although there are many violations of complicity in international law, it is aimed to draw the boundaries of the concept clearly in order to prevent these violations. In this respect, a revised model of responsibility for complicity regimes in internationally wrongful acts has been advised and it is aimed to draw attention to the deficiencies in the implementation of the codified rules.
