Türk Hukukundaki Mevduat Rehnine, Teminat İşlemleri İçin Uncitral Model Kanun Açısından Bir Bakış

Abstract

Mevduat üzerinde rehin, kredi taleplerinin karşılanmasında aranan bir teminattürü olarak hem kolay kurulabilmekte hem de rehnin hızlı bir şekildeparaya çevrilmesi mümkün olmaktadır. Ekonomik ve ticari hayatta daha fazlayer tutması gereken mevduat üzerinde rehnin, uluslararası uygulamalarınınyeterince incelenmemiş olması da bizi bu makale konusunu yazmaya sevk etmiştir.Makalemizde, mevduat üzerinde rehnin Türk hukuku ile teminat işlemleriiçin Birleşmiş Milletler Uluslararası Ticaret Hukuku Komisyonu tarafındançıkarılan model kanundaki düzenlenişi Medeni Hukuk ve Borçlar Hukukubakımından ele alınacaktır.TMK’da özellikle mevduat rehnine yönelik bir düzenleme mevcut değildir.Bu bakımdan mevduat rehni, TMK’nın “Taşınır Rehni” başlıklı 3. Bölüm2. Ayırım’da “Alacaklar ve Diğer Haklar Üzerinde Rehin” başlığı altında yeralan 954 vd. maddelerindeki düzenlenmelere tabi olacaktır. UNCITRAL ModelKanun’da ise “Bir teminat hakkı oluşturmak” başlıklı İkinci Kısım’da yeralan “Banka Hesabına Yatırılan Fonların Ödenmesi İlişkin Haklar” başlıklı 15.Madde ve devamındaki maddelerde düzenleme getirilmiştir

The pledge on deposit as a type of security for loan requests can be easily put and it can also quickly be realized. There isn’t enough research on the international application of the pledge on deposit which should take more place in the economic and commercial life and this leaded us to write on this article subject. On our article, regulation of the pledge on deposit regulated under Turkish Law and the model law issued by United Nations Commission on International Trade Law for security transactions will be discussed with regard to the Civil Law and the Law of Obligations. There isn’t any specific provision regarding the pledge on deposit in the TCL. In this regard the pledge on deposit, is subject to the provisions of Article 954 and the following articles under the title of “Pledges on Receivables and Other Rights” at the Part 3, Distinction 2 with the title “Movable Property Pledge” of the TCL. It is also regulated in the UNCITRAL Model Law under the Article 15 and the following articles under the title of “Rights to payment of funds credited to a bank account” placed in the Second Part with title of “Creation of a security right”.
