Abstract

İş görme ediminin ifa yerinin işverene ait işyeri olması asıl ise de işin niteliği ya da işverenin talimatı işçinin işyeri dışında iş görmesini gerekli kılabilir. İşçinin iş görme amacıyla yer değiştirmesini gerektiren bu durumlar iş seyahati kavramıyla ifade edilir. İşçinin geçici bir süre için mutat çalışma yeri dışında görevlendirilmesi anlamına gelen iş seyahati mevzuatımızda özel olarak düzenlenmiş değildir. Çalışma yaşamında yaygın bir pratiği olmasına rağmen bugüne kadar bilimsel bir çalışmaya konu olmamıştır. Bu önemli bir eksikliktir. Zira iş seyahati -başta kavramın kendisi olmak üzere- pek çok belirsizliği içermektedir. İş seyahati sırasında yolda geçen sürelerin çalışma süresi olarak mı yoksa dinlenme süresi olarak mı nitelendirileceği, yapılan masrafların ne şekilde karşılanacağı, meydana gelen kaza ve hastalık hallerinden işverenin hangi hallerde sorumlu olacağı gibi bir dizi meselenin açıklığa kavuşturulması gerekir.While the primary location for the performance of work is the employer's workplace, the nature of the job or the employer's instructions may require employees to work outside the workplace. Situations requiring employees to change locations to perform work are referred to as business trips. Business trips, as a temporary assignment of an employee outside his/ her usual place of work, are not specifically regulated in our legislation. Although it is a common practice in business life, it has not been examined until now. This is a big shortcoming. Because business trips -including the concept itself- involve many uncertainties. It is crucial to clarify a series of issues, such as whether the time spent on the road should be considered as working time or rest time, how the expenses will be covered, and under what circumstances the employer will be liable for the damages arising from accidents and illnesses that occur during the trip.
