İstanbul Bâb Mahkemesi 107 No'lu Şer'iyye Sicil Defteri'nin transkripsiyonu ve değerlendirmesi (H.1126-1127/ M.1714-1715)

Abstract

Şer‘iyye sicil defterleri kayıt altına alındıkları döneme ait sosyo-ekonomik, siyasi, kültürel vb. pek çok alana ait bilgiler veren değerli belgelerdir. Osmanlı Devleti’nin hukuk sisteminin nasıl işlediğini gösteren birincil derecede öneme haiz bir membadır. Bu tez çalışmasında H. 1126-1127 / M. 1714-1715 yılları arasında kayıtlanmış İstanbul Bâb Mahkemesi 107 Numaralı Şer‘iyye Sicil Defteri’nin transkripsiyon ve değerlendirilmesi yapılmıştır. Defter 42x15 ebatlarında olup 78 varak ve 401 hükümden oluşmuştur. Bu defterde geçen davaların içerikleri boşanma, alım-satım, miras, alacak-verecek, sulh, nafaka gibi konulardır. Giriş bölümünde kısaca genel bir bilgilendirilme yapılmıştır. Birinci bölümde Osmanlı Devleti’nin hukuk yapısı, mahkemeleri ve kadılık müessesesi ve diğer mahkeme görevlilerine dair bilgiler mevcuttur. Tezin ikinci bölümünde konumuz olan şer‘iyye sicilleri ve defterimizde bulunan belge türleri incelenmiştir. Üçüncü bölümde İstanbul Bâb Mahkemesi 107 Numaralı Şer‘iyye Sicil Defteri’nin değerlendirilmesi yer almakta olup dördüncü bölümde transkripsiyonlu ve özetli metni bulunmaktadır.

Şer‘iyye registery books are very important documents which contain political, social, economic, cultural and many more information during their times. These documents have primary degree importance to Show how Ottoman law system works. İn this thesis, Şer‘iyye Registery book with no 107 which has been recorded in (Hijri) H.1126-1127/ M. 1714-1715 years at İstanbul Bâb court, is being transcriped and evaluated. The book is 42x15 in size and consists of 78 sheets and 401 provisions. The contents of the cases in this book are such issues as divorce, purchase and sale, inheritense, exchange (dept-paying), compromise, alimony, etc. A brief general information was given in introduction section. İn the first section there is information about the Ottoman legal structure, courts and the kadi (qadi) establishment and the other court officials. İn the second section of the thesis the şer‘iyye registries and the types of document found in our book were examined. İn the third section includes the evaluation of the İstanbul Bâb Court’s Şer‘iyye Registry no 107 book, and the fourth section has a transcribed and summarized text.
