Abstract

Toplu iş sözleşmesinin her iki tarafı, yetkili iş mahkemesinde dava açarak toplu iş sözleşmesinin yorumlanmasını talep edebilir. Yorum davası açma hakkı, yalnızca toplu iş sözleşmesinin taraflarına tanınmıştır. Dolayısıyla toplu iş sözleşmesinin tarafı olmayan işçiler yorum davası açamaz. Yorum davasına bakan mahkeme en geç iki ay içinde karar vermelidir. Yürürlükten kalkan 2822 sayılı Sendikalar, Toplu İş Sözleşmesi, Grev ve Lokavt Kanunu kesinleşen yorum ilamına aykırı davranan taraf için bir tazyik para cezası içermekteydi. Bununla beraber, yürürlükteki 6356 sayılı Sendikalar ve Toplu İş Sözleşmesi Kanunu’nda tazyik para cezasına ilişkin herhangi bir düzenleme yer almamaktır.

Either party to a collective agreement may lodge a suit with the competent labour court and may request an interpretation of the col?lective agreement.
