Devletin temel görevlerinden birisi de şüphesiz kamu düzeni ve güvenliğini sağlamak ve korumaktır. Dünyada ve ülkemizde terör ve organize suç örgütlerinin, masum insanları tehdit ettiği görülmektedir. Terörle ve organize suç örgütleri ile mücadele edilebilmesi amacıyla klasik tedbirlerin yetersiz olduğu görülmüştür.5397 sayılı yasa ile Polis, Jandarma ve Milli İstihbarat Teşkilatlarına önleme amaçlı iletişimin denetlenmesi yetkisi verilmiştir. Böylece yalnızca yasa ile belirlenmiş şekliyle gerçekleşmesi halinde kamu düzenini bozabilecek nitelikteki suçların önlenmesi amaçlanmıştır. 5397 sayılı yasa ile iletişimin denetlenmesi isimli bu çalışmamız iki bölümden oluşmaktadır. Birinci bölümde, kavramlar ile anayasalarda iletişimin denetlenmesi, hukuk devletinde bağlayıcı nitelikteki ilkeler ışığında iletişimin denetlemesi, dünyada ve özellikle gelişmiş demokrasiler çerçevesinde önleme amaçlı iletişimin denetlenmesi, AİHS ve AİHM içtihatları çerçevesinde ele alınmış, ikinci bölümde ise, Türk hukukunda önleme amaçlı iletişimin denetlenmesi, tedbirinin tanım ve kapsamı, icrası, uygulanma koşulları, sona ermesi, tedbire başvurulması sonucu elde edilen verilerin kullanımı ile tedbirin denetim şekilleri, hukuka aykırı olarak önleme amaçlı iletişimin denetlenmesi tedbirine başvurulması şartları ile tedbir sonucu tesadüfen elde edilen verilerin değeri, konuları ele alınmıştır. ABSTRACT It is certain that one of the fundamental duty of the state is to protect and provide the public order and security. Both in the world and in our country, terrorist organizations and organized crime groups are threatening innocent people. Classical tactics and tecniques are not enough in order to counter terrorism and organized crimes. In the law No. 5397, authority to monitoring communications for the purpose of prevention is bestowed to Police, Gendarmerie and National Intelligence Agency. Thus,it is intended to prevent crimes which are determined by the law and would cause outrage in the public. Our study “The monitoring of communications according to law No. 5397” consists of two chapters. In the first chapter, “General informations, concepts and the monitoring of communications in terms of constitutions”, “monitoring of communications in the light of binding disciplines of contitutional state” , “monitoring of communications for the purpose of prevention within the framework of the European Human Rights Law In the world and especially in the advanced democracies” are discussed within the framework of the ECHR and the jurisprudence of the Court. In the second chapter, “monitoring of communications in Turkish Law”, “definition, content and execution of this measure”, “execution conditions”, “termination of the measure”, “the use of the data obtained as a result of the monitoring and forms of control of this measure”, “conditions of illegal monitoring of communication” and “the data incidentally obtained as a result of this measure” are discussed.
