Abstract
Hallâc-ı Mansur, daha yaşadığı çağda tartışma konusu olan güçlü bir sûfî şahsiyettir.Döneminde sûfîler arasında etkili olduğu gibi halk kitleleri arasında da etkili olmuştur. Sözleri ve davranışları dönemin uleması ile mutasavvıfları arasında tartışmaya yolaçarken, dönemin olayları nedeniyle teyakkuzda olan devlet erkânı arasında da huzursuzluğa neden olmuş; bu sebeple H. 301 yılında tutuklanmış, yargılanmış, sekizyıl hapiste ve gözetim altında tutulmuş, H. 309 yılında da devrin veziri Hamid b.Abbas tarafından yeniden mahkeme kurularak başkanlığını Malikî Kadı Ebû Ömer’inyaptığı bir heyet tarafından idama mahkûm edilmiştir. Hallâc idam edildikten sonrahakkındaki tartışmalar bitmediği gibi daha da artmıştır. Daha sonra gelen fakihlerinçoğunluğu idam kararını doğru bulmuş; sûfîler ise haksız bulmuştur. Bununla birlikteidam kararını haklı bulmayan fakihler olduğu gibi, idam kararını doğru bulan sûfîlerde vardır. İdam kararını doğru bulan fakihler, Hallâc’ın sözlerini de değerlendirmekle birlikte, büyük oranda yargılayan mahkeme heyetinin fakihlerden oluşmasına veonların bu husustaki oybirliğine, ayrıca dönemin fakihlerinin bu karara itiraz etmeyişlerine atıfta bulunmuşlardır. Bu makalede Hallâc’ın hayat hikâyesine değinildiktensonra özellikle mahkeme süreci ve hakkında söylenenler olabildiğince nesnel şekildeaktarılarak, yargılama süreci ve verilen hüküm hakkında değerlendirme yapılmıştır.
Mansur al-Hallaj is a significant sufi figure who was the topic of controversies even in_x000D_ the period he lived. During his life, he affected both sufis and the people. His sayings and_x000D_ behaviours induced disputes between sufi scholars and ulema and he also made high_x000D_ state officials, who were excessively careful because of the circumstances of that era, uncomfortable. Thus, he was imprisoned at 301 H., judged at the court, kept in prison for_x000D_ eight years and he was condemned to the death by Hameed ibn Abbas, Vizier of the era,_x000D_ at 309 H. by the fatwa of Abu Omar, who was a Maliki qadi . With his execution, the_x000D_ controversy about him has not ended, on the contrary,it has increased even more. Most_x000D_ of the fuqaha after him have approved the decision of execution, but the sufis have not._x000D_ On the other hand, some fuqaha have not found the death sentence justified and there are_x000D_ some sufis who think the decision of the court was appropriate. The fuqaha, who found_x000D_ the execution decision correct, have evaluated the words of Hallaj, but also reminded of_x000D_ the court board composed of the judges and of their unanimity in this regard, as well as_x000D_ the fact that the judges of that period did not object to this decision. In this article, after_x000D_ touching on Hallaj's life story, we make an evaluation of the trial process and the verdict_x000D_ through transmitting, as objective as possible, especially the court process and what has_x000D_ been said about him.
