Publication: Kasten öldürmeye teşebbüs ve kasten yaralama suçlarının manevi unsur bakımından ayırt edilmesi
Abstract
Çalışmada; genel olarak manevi unsur ve kast kavramı, öldürme ve yaralama suçları bakımından kast, öldürme ve yaralama kastının birbirinden ayırt edilmesi ve öldürmeye teşebbüs ile yaralama suçlarının kast bakımından ayrılmasında, Yargıtay ve öğreti tarafından ortaya konulan kriterler inceleme konusu yapılacak, kastın ispatı ve kast bakımından şüpheden sanık yararlanır ilkesinin ( in dubio pro reo ) uygulama alanı incelenecektir.
In this study, the general meaning of the psychological element and the concept of intentional killing, the aspect of intentionally killing and intentionally injuring crimes, when distinguishing intentionally killing from intentionally injuring and distinguishing intentionally killing crimes from intentionally injuring crimes in terms of intention, the criteria put forward by the Turkish High Court of Appeals and doctrine will be the subject of examination. As well, the practice area of the element of the benefit of doubt and proving intention will be scrutinized.
