Endüstriyel tasarım tescil başvuru sürecinin irdelenmesi

Abstract

Bu tez, ülkemiz için çok da eski olmayan endüstriyel tasarımların korunması kavramını ve tescil sürecini hem tarihsel hem de kavramsal olarak irdelemektedir. Çalışmanın esasını teşkil eden kavramlar, başta 554 sayılı Endüstriyel Tasarımların Korunması Hakkında Kanun Hükmünde Kararname ve bu Kararnamenin uygulama şeklini gösterir Yönetmelik olmak üzere, kanuni düzenlemeler kapsamında ele alınarak değerlendirilmiştir. Çalışmanın giriş bölümünde tez konusunun seçiminde rol oynayan sebepler ortaya konmuştur. tezin konusunu oluşturan “endüstriyel tasarım” ve “tescil” terimlerinin tanımlanmasına ayrılmıştır. İkinci bölümde “tasarım hakkı” kavramı tanımlanarak, sınai mülkiyet kavramının ulusal ve uluslararası alanda tarihsel gelişimi araştırılmıştır. Üçüncü bölüm, endüstriyel tasarımların tescille korunmasını ele almaktadır. Bu bölümde bir tasarımın korunması için gerekli şartlar ve tescil edilmiş bir tasarımın sahibine kazandırdığı haklar kanunsal çerçevede irdelenmiştir. Dördüncü ve son bölümde ise, endüstriyel tasarım olarak tanımlanmış bir ürünün Türkiye’de tescil edilebilmesi için başvurulması gereken kurum ve yapılması gereken işlemler detaylı olarak incelenmiştir.

This thesis both historically and conceptually explicates the protection of industrial designs and the process of their registration which doesn’t date long back for our country. The concepts which form the basis of this study are considered within the context of legal arrangements, especially Decree Law No: 554 Pertaining to the Protection of Industrial Designs and the Implementing Regulations under the Decree Law No: 554 Pertaining to the Protection of Industrial Designs. In the introduction section, the reasons for choosing thesis topic are explained. In the first section, the terms “industrial design” and “registration” are determined. In the second section, the term “design rights” is defined and the international and national historical development of intellectual property protection is ascertained. In the third section, the protection of registered industrial designs is considered at length. In this section, the required conditions for protection of an industrial design and the rights that are vested by industrial design registry are examined in legal framework. In the fourth and final section, the institution that accepts design registry applications for the products which are identified as industrial designs is introduced and the design registry process is examined in detail.
