MALA ZARAR VERME SUÇLARI (YTCK. m.151 vd.) Çalışmamızda, 5237 sayılı Kanunun 151 vd. maddelerinde düzenlenmiş olan mala zarar verme suçları incelenmektedir. Malvarlığına karşı suçlara ilişkin yapılan genel açıklamalardan sonra, mala zarar verme suçları üç başlık altında açıklanmaktadır. Bunlardan birincisi, Kanunun 151/ 1. maddesinde yer alan mala zarar verme suçu, ikincisi, Kanunun 151/ 2. maddesinde yer alan sahipli hayvana zarar verme suçu, üçüncüsü ise, Kanunun 153. maddesinde yer alan ibadethanelere ve mezarlıklara zarar verme suçudur. Her bir suç tipi hakkında yapılan genel açıklamalardan sonra, bu suçlar ile korunan hukuki yarar, benzer suçlardan farkı, suçun konusu, faili ve mağduru, maddi ve manevi unsuru belirtilip, suçun özel görünüş şekillerine ilişkin açıklamalar yer almaktadır. Daha sonra suçun nitelikli halleri incelenip, suçun müeyyidesi ve kovuşturma usulü açıklanmaktadır. Son olarak ise, bu suçlara ilişkin ortak hüküm niteliği taşıyan şahsi cezasızlık sebebi ve cezada indirim yapılmasını gerektiren şahsi sebep ile etkin pişmanlık hali incelenmektedir. Çalışmanın bütününde konu ile ilgili doktrinde yer alan tartışmalara değinilmekte ve bizim benimsemiş olduğumuz görüşler gerekçeli olarak aktarılmaktadır. After the general statements with regard to the crimes against property holding, crimes of harming the property are being explained under three titles. First is the crime of harming the property under the article 151/ 1 of the Code, second is the crime of harming the owned animals under the article 151/ 2 of the Code and third is the crime of harming the places of worship and graveyards. After the general statements with regard to each of these crime types, the legal benefit protected by these crimes, its difference from similar crimes, subject of the crime, its perpetrator and victim, its spiritual and material element is mentioned and this is followed by the explanations regarding the particular aspect of the crime. Later, the quality state of the crime is examined and its sanction and investigation method is explained. Finally, the reason of individual unpunishment and effective penitence status that carries a common judgment for these crimes are examined. In the overall, the discussions that take place in the related doctrine with regard to the issue are mentioned and the opinions adopted by us are communicated on legal ground.
