İşe iade davasında karar ve kararın icrası

Abstract

İş sözleşmesi işveren tarafından feshedilen işçi, eski işine dönmek amacıyla, bu feshin geçersizliğinin tespiti için işe iade davası açabilir. Bu çalışmada, işe iade davasında verilebilecek kararlar ve bu kararların icrası bütün yönleri ile incelenmiştir. Çalışma dört temel bölümden oluşmaktadır. İlk bölümde, yargısal kararlar ve iş güvencesi hakkında verilmiştir. İkinci bölümde, usule ilişkin nihai kararlar incelenmiştir. Üçüncü bölümde, hüküm ve hükmün icrası açıklanmıştır. Son bölüm ise “Ara Kararları” başlığını taşımaktadır. Bu bölümde bilhassa iş ilişkisinin ihtiyati tedbir yoluyla düzenlenmesi üzerinde durulmuştur.

The employee, whose employment contract has been terminated by the employer, may file an action for reemployment to determine the invalidity of this termination. In this study, decisions that can be made in the reemployment lawsuit and the execution of these decisions examined in all aspects. The thesis consists of four fundamental parts. In the first part, general information about judicial decisions and job security discussed. In the second part, final decisions regarding the procedure examined. In the third part, the judgement and execution of the judgement explained. The last part is entitled Interlocutory Decisions. This chapter focuses on the regulation of the employment relationship through preliminary injunctions.
