Basın İş Kanunu Kapsamında Çalışan Gazetecilerin Çalışma Süreleri

Abstract

Türk İş Hukuku’nda gazetecilerin çalışma ilişkileri, 5953 sayılı Basın Mesleğinde Çalışanlarla Çalıştıranlar Arasındaki Münasebetlerin Tanzimi Hakkında Kanun’da (Basın İş Kanunu) düzenlenmiştir. Basın İş Kanunu, çalışma ilişkilerine ilişkin birçok konuda olduğu gibi çalışma süreleri konusunda da ayrıntılı düzenlemeler içermemektedir. Yine, Kanun, 4857 sayılı İş Kanunu’ndan farklı olarak çalışma süreleri konusunda katı hükümler içermektedir. Bu nedenle, çalışma süresi kavramı, buna bağlı olarak hangi sürelerin çalışma süresinden sayılacağı, esnek çalışma modellerinin gazeteciler açısından uygulanması ve fazla çalışma konularının 5953 sayılı Kanun yönünden ayrıca değerlendirilmesi gerekecektir. Aşağıda bu çerçevede konu incelenecektir.

In Turkish Labour Law the labour relations of journalists are regulated in Law No. 5953 on the Regulation of Relations Between People Who Works In the Press and People Who Employs in the Press (The Press Labour Code). The Press Labour Code does not include detailed regulations on working time, as is the case with many aspects of labour relations. Again, unlike Labour Law No. 4857, there are rigid provisions on working hours. For this reason, the issues like the concept of working time, the periods to be considered as working time, flexible working models to be applied for journalists and overtime issues needs to be evaluated separately in terms of Law No. 5953. This subject will be examined below.
