İFLASIN ERTELENMESİ KURUMU ÇERÇEVESİNDE İHTİYATİ TEDBİR KARARININ KAPSAMI, NİTELİĞİ ve ETKİLERİ

Abstract

Kendine özgü bir geçici hukuki koruma olan iflasın ertelenmesi yargılamasında hâkim İİK m.179/a hükmüne dayanarak ihtiyati tedbir kararı verebilir. Bu ihtiyati tedbir kararıyla iflasın ertelenmesi kararının etkisi bir anlamıyla geriye çekilmiş olur. Bu özelliği dolayısıyla bu ihtiyati tedbir ifa amaçlı bir tedbirdir. İİK m. 179/a hükmüne göre verilen ihtiyati tedbir kararında ispat ölçüsü yaklaşık ispatın üzerinde kabul edilmelidir. Ayrıca talep üzerine derhal tedbire karar verilmemeli, hızlı bir bilirkişi incelemesi yapılarak karar verilmelidir.

On the basis of İİK m. 179/a the court has competence to decide on provisional injuctions. As a conclusion of this injunction the effect of postponement of bankruptcy is occured before the court sentence. Because of its characteristic these injuctions aim at the performance. The approximate proof standard has to be sought by the court as the standard of proof. The court should examine the conditions of postponement of bankruptcy with the help of expertise before to dedice on provisional injuctions.
