Hanefi usûl düşüncesinde delâlet çeşitleri arası teâruz ve çözüm yolları

Abstract

Kur'an ve Sünnet naslarının şerʻî ahkâmı anlamada aslî kaynaklar olması nedeniyle bu naslardaki lafız ve mana arasındaki irtibatı ve lafzın hükme delâleti büyük önem arz etmektedir. Nasları doğru bir şekilde yorumlamak, lafzın manaya delâletini anlamakla sıkı bir şekilde bağlantılıdır. Bu nedenle usul âlimleri, eserlerinde lafızlar konusuna öncelik vermiş ve detaylı bir şekilde tartışmışlardır. Bu tartışmalarla hukukta subjektiflikten kaçınıp dil ve mantık kuralları çerçevesinde objektif bir hukuk metodolojisi ortaya koymaya çalışmışlardır. Ancak çeşitli ilmî tutumları nedeniyle lafızların taksiminde mütekellimîn, fukaha (Hanefî) ve memzûc metod lafızları kendi doktrinleri çerçevesinde incelemişlerdir

Since the Qur'an and the Sunnah are the main sources of the shar'ah, it is of utmost importance that the relation between the text and the meaning of the Qur'an and the Sunnah are discussed. The correct interpretation of words is closely related to the understanding of the meaning of the textual implications. For this reason, scholars in their works have given priority to the types of alfaz and discussed them in detail. In these discussions, they attempted to avoid subjectivity in law and to establish an objective legal methodology within the framework of language and logic rules.
