Zeydî usûlcülerinden İmam Nâtık-Bilhak'ın icmâ anlayışı : El-Müczî örneği

Abstract

Nâtık-Bilhak, Zeydî mezhebinin en önemli simalarından biri olmasıyla birlikte usûl-i fıkıh başta olmak üzere çeşitli ilim dallarında da adından söz ettiren şahsiyetlerden biridir. Bu çalışmada onun Zeydî usûl literatüründe önemli yere sahip olan el-Müczî fî usûli'l-fıkh adlı eserinin icmâ bölümü incelenmeye çalışılmıştır. Bu çerçevede Nâtık-Bilhak’ın İslam hukukunun deliller hiyerarşisinde cumhurun kabulüne göre üçüncü sırada yer alan icmânın delil teşkil edişinin temellendirme şekli, icmânın şartları, türleri, icmâya katılabilecek kişilerin ehliyeti gibi konular hakkındaki görüşlerinin ortaya konulması hedeflenmiştir.

Being one of the most important figures of the Zaydi sect, Nâtik-Bilhak is as well as one of the well-known personalities in various branches of science, especially in the method of fiqh. In this study, the ijma section of his work named al-Muczî fî usûli'l-fiqh, which has an important place in the Zaidi methodology literature, has been tried to be examined. In this context, it is aimed to reveal the views of Nâtik-Bilhak on issues such as the way of justifying the evidence of ijmâ, which is the third in the hierarchy of evidence in Islamic law according to the acceptance of the majority, the conditions and types of ijmâ, and the qualifications of people who can participate in ijmâ.
