Tele çalışmada işçinin hak ve borçları

Abstract

Bilgi ve iletişim çağında dünyada yaşanan teknolojik gelişmeler iş hukukunu da etkilemektedir. Klasik iş yerinde tipik çalışma yöntemlerinden uzaklaşılmakta; dijitalleşme başta olmak üzere küreselleşme ve rekabet gibi unsurlar atipik iş ilişkilerinin yaygınlaşmasına sebep olmaktadır. Covid-19 pandemi koşulları da bu süreci hızlandırmıştır. Bu gelişmeler karşısında işçinin zamandan ve mekândan bağımsız bir şekilde iş görmesi sonucunu doğuran esnekleşme ile çeşitli çalışma modelleri ortaya çıkmıştır. Çalışmamızda teknolojik gelişmelerle daha da görünür hale gelen tele çalışma modeli ile tele çalışmada işçinin hak ve borçları ele alınmıştır. Çalışma ilişkisinde işçinin hakları ve borçları incelenirken genel açıklamalara da yer verilmekle birlikte tele çalışma yönteminde farklılaşan yönleriyle ve uygulama sorunlarıyla değerlendirilmeye çalışılmıştır. İşçinin temel hak ve borçları ile birlikte dijital iş araç ve malzemelerinin kullanılması dolayısıyla özellikle işverenin denetim ve gözetim yetkisini kullanırken başvurduğu yöntemler, işçinin kişilik haklarının korunması ekseninde ve içtihatlarla detaylıca açıklanmıştır. Hukukumuzda son dönemde tartışılmaya başlanan ulaşılamama hakkının da kapsamlı bir şekilde üzerinde durulmuştur.

The technological developments occurring in the world during the information and communication age are also impacting labor law. The traditional workplace and typical working methods are being abandoned; factors such as digitization, globalization, and competition are leading to the widespread adoption of atypical employment relationships. The conditions created by the Covid-19 pandemic have accelerated this process. In response to these developments, various working models have emerged with flexibility that allows employees to work independently of time and place.In our study, the telework model, which has become more prominent due to technological advancements, and the rights and obligations of employees in telework are examined. While evaluating the rights and obligations of employees within the working relationship, general explanations are provided but the focus is on the aspects that differ in the telework method and the practical issues it presents. Along with the fundamental rights and obligations of employees, the methods employed by employers to exercise their control and supervision authority, particularly due to the use of digital work tools and materials, are thoroughly explained in the context of protecting the employee's personal rights, supported by case law. The right to disconnect which has recently been debated in our legal system is also extensively discussed.
