Fahreddin Er-Râzî’de dilde kesinliğe engel durumların tercihi ve fıkhi hükümlere etkisi

Abstract

FAHREDDİN ER-RÂZÎ’DE DİLDE KESİNLİĞE ENGEL DURUMLARIN TERCİHİ VE FIKHİ HÜKÜMLERE ETKİSİ Şer’î delillerin kesinliği problemi, fıkıh usûlünün en önemli konularındandır ve Şârî’in buyruğunun temellendirilmesi de buna bağlıdır. Râzî’yle birlikte ilk defa gündeme gelen bu tartışmada, Karâfî, İbn Teymiyye ve Sadrüşşerîa gibi sonraki dönem usulcüler bazı delillere dayanarak şer’î delillerin yakin ifade ettiği görüşünü benimseyerek Râzî’ye eleştiri getirmişlerdir. Râzî, şer’i delillerin kesinlik ifade etmediğini “dille ilgili bilgilerin intikali, bağlamsal unsurlar ve dilde kesinliğe engel durumlar” gibi faktörlere dayandırır. Ona göre şer’î delillerin kesinliğinden bahsedebilmek için bu üç faktörün bulunmaması gerekir. Bu çalışma, Fahreddin er-Râzî’nin Şer’î delillerin kesinlik ifade etmemesi için varlığını zorunlu gördüğü unsurlardan dilde kesinliğe engel durumların mevcudiyeti halinde bunlar arasındaki tercih kriterlerini ortaya koymayı hedeflemektedir. Bu amaçla Râzî tarafından dilde kesinliğe engel durumlar olarak sayılan iştirak, nakil, izmar, mecaz ve tahsis konuları Râzî’nin el-Mahsûl ve el-Meâlim isimli eserleri ve bunlar üzerine yazılan bazı şerhler çerçevesinde ele alınmıştır. Öncelikle Râzî’nin dilde kesinliğe engel durumların mâhiyeti ile ilgili görüşleri kendi metinlerinden hareketle ortaya konmuş ardından bu teorik çerçevenin fıkhî hükümlere yansımaları Karâfî’nin “Risâle fî meseleti te’âruzi’l-ihtimâlâti’l’ aşreti’l-muhille bi’l-fehm fi’t-tehâtub: el-mezkûra fî kitâbi’l-Mahsûl fî ilmi’l-usûl li’l İmâm Fahreddîn er-Râzî” risalesindeki örnekler üzerinden değerlendirilmiştir..

FAHREDDIN ER-RÂZÎ'S PREFERENCES ABOUT THE SITUATIONS THAT OBJECT TO ACHIEVEMENT IN LANGUAGE AND THEIR EFFECTS ON LEGAL NORMS IN ISLAMIC LAW The problem of certainty of evidence in the methodology of Islamic law is one of the most important issues of the methodology of Islamic law. The discussion about the issue came to the fore with Razi for the first time. After that, proceduralists such as Qarafi, Ibn Taymiyya and Sadrüşşerîa criticized Razi by adopting the view that the evidences in the Islamic legal methodology express certainty based on some evidence. Razi bases that the evidence in the Islamic legal methodology does not express certainty on factors such as the imprecision of linguistic information to reach us, contextual elements and situations that prevent certainty in the language. According to him, in order to talk about the precision of the evidence in the Islamic legal methodology, some elements must be absent. This study aims to reveal the preference criteria among the factors that Fahreddin er-Razi deems obligatory in terms of the lack of certainty in the evidence in the Islamic legal methodology, in the presence of situations that prevent certainty in the language. For this purpose, the issues of iştirak, nakil, izmar, mecaz and tahsis , which are considered by Razi as barriers to certainty in language, are discussed within the framework of Razi's works named al-Mahsûl and al-Meâlim and some commentaries written on them. First of all, Râzî's views on the nature of the situations that prevent certainty in language were put forward from his own texts, and then the reflections of this theoretical framework on the norms in Islamic law, Karafî's Risâle fî meseleti te’âruzi’l-ihtimâlâti’l’ aşreti’l-muhille bi’l-fehm fi’t-tehâtub: el-mezkûra fî kitâbi’l-Mahsûl fî ilmi’l-usûl li’l İmâm Fahreddîn er-Râzî has been evaluated through the examples.
